<br />I <br /> <br />I <br /> <br />against any claim or claims for damages due to any injury to any <br /> <br />adjacent or addQiJling property, arisinq or growing out of the <br />performance of the Contract. <br /> <br />VIII. <br /> <br />Contractor will execute performance and payment bonds each <br /> <br /> <br />ln the sum of one hundred (100) percent of the total contract <br /> <br /> <br />price, in standard forms for this purpose, guaranteeing faith- <br /> <br />ful performance of the work described by this Contract and the <br /> <br /> <br />fulfillment of any guarantees required and further guaranteeing <br /> <br /> <br />payment to all persons supplying labor or materials or furnishing <br /> <br /> <br />equipment in the execution of this Contract. For purposes of <br /> <br /> <br />setting the amount of the performance and payment bonds, the <br /> <br /> <br />contract price shall be the total of the value of the salvageable <br /> <br /> <br />materials and any monetary amount paid by City to Contractor. <br /> <br /> <br />The value of the salvageable materials shall be set by agreement <br /> <br /> <br />between City and Contractor. It is agreed that this Contract <br /> <br /> <br />shall not be in effect until such performance and payment bonds <br /> <br /> <br />are furnished and approved by City. <br /> <br />IX. <br /> <br />It is expressly agreed that Contractor shall seal to City's <br /> <br />satisfaction the portion of Old City Hall previously adjacent to <br /> <br />said Annex which remains standing after said demolition. Any <br /> <br />opening created in the wall of the abutting Old City Hall by <br /> <br />said demolition shall be completely boarded shut by Contractor <br /> <br />with half-inch (~") plywood. <br /> <br />X. <br /> <br />Contractor agrees to indemnify and hold harmless City from <br />all liability, damages, claims, losses, demands, suits, judgements, <br />costs including reasonable attorneys' fees and expenses arising <br />from the demolition of the Old City Hall Annex in San Marcos, Hays <br />County, Texas. Further, such indemnity shall apply and Contractor <br />II shall defend any litigation arising in connection with such demoli- <br />tion whenever said liability, damage, claim, loss, demand, suit, <br /> <br />3 <br />
