<br />judgment, cost including reasonable attorneys' fees and expense <br />is caused in whole or ln part by any negligent act or omission of <br />Contractor, anyone directly or indirectly employed by Contractor <br />or anyone for whose acts Contractor may be liable regardless of <br /> <br />whether said liability, damage, claim, loss, demand, suit, judgment <br /> <br /> cost including reasonable attorneys' fees or expense is caused on <br />I part by City. <br /> XI. <br /> Contractor agrees to file with City a policy of public liabil- <br /> ity insurance issued by a casualty insurance company duly authorized <br /> <br />I <br /> <br />I <br /> <br />to do business in the State of Texas with the minllimum limit of one <br />hundred thousand dollars ($100,000.00) per person and three hundred <br />thousand dollars ($300,000.00) for any single occurrence of bodily <br />injury or death and one hundred thousand dollars ($100,000.00) for <br />any single occurrence for injury to or destruction of property. <br />Said insurance policy shall name City as co-insured. Said insurance <br />shall contain an endorsement that such insurance may not be cancelled <br />or amended with respect to Contractor without ten (10) days written <br />notice by certified mail, return receipt requested, to City by the <br />lnsurance company. City shall not be required to pay any of the <br />premlums for said policy. Any insurance policy herein required or <br />procured by Contractor shall contain an express walver of any <br />rights of subrogation by the insurance company against City. A <br />certificate of insurance for each policy so procured shall be filed <br />with City within ten (10) days of receipt by Contractor of the <br />written notice described in Part II of this Contract. The mlnlmum <br />limits of any insurance coverage herein required shall not limit <br />Contractor's liability under Part X of this Contract. <br />XII. <br />Contractor shall at all times observe and comply with all <br />federal, state and local laws, ordinances and regulations which <br />in any manner affect the work under this Contract, and shall <br />indemnify and save harmless City against any claim arising from <br />the violation of any such laws, ordinances and regulations. <br /> <br />4 <br />
