<br />I <br /> <br />I <br /> <br />I <br /> <br />70 <br /> <br />. , <br /> <br />regular meeting <br /> <br />page five <br /> <br />november 24, 1980 <br /> <br />AYE: Cavazos, James, Kraus, Stokes <br /> <br />NAY: Brown, Norris, Tarbutton <br /> <br />The motion failed as it did not have a three-fourths majority <br />required since petitions of objection had been received from <br />persons owning more than 20% of the property within 200'. <br /> <br />The Mayor introduced for consideration a public hearing and first <br />reading of an Ordinance read in its entirety having the following <br />caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, M1ENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY CHANGING THE <br />ZONING OF PART OF LOTS 1 AND 2 AND LOTS 5 AND 6 OF THE <br />COLLEGE HEIGHTS ADDITION, LOCATED AT 1106 N. L.B.J. DRIVE, <br />FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "M" (MIXED). <br /> <br />The Mayor then opened the public hearing. Max Warshauer stated <br />his objections to the proposed zoning change. Mrs. Anderson also <br />stated her objections. Ed Green, the applicant, was present and <br />stated his reasons for requesting the zoning change. The Mayor <br />then closed the public hearing. Mr. James moved to deny the request. <br />Mrs. Norris seconded the motion. On roll call, the following vote <br />was recorded: ' <br /> <br />AYE: Brown, Cavazos, James, Norris, Stokes, Tarbutton <br /> <br />NAY: None <br /> <br />ABSTAIN: Kraus <br /> <br />The Mayor submitted a written statement exp1aining his abstention <br />from the vote. A copy of the statement is attached and made a part <br />of these minutes. <br /> <br />The ~Mayor introduced for consideration a public hearing and first <br />reading of an Ordinance read in its entirety having the follow~ng <br />caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, MiENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED SEPTEHBER 29, 1980 (VOL. 54) BY CHANGING THE <br />ZONING OF 12.11 ACRES OUT OF THE HOLLAND HILLS ADDITION, <br />FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "TH" (TOW~HOUSE). <br /> <br />The Mayor then opened the public hearing. Gil Fulmer, representing <br />the Holland Hills Area, stated their opposition to the high density <br />development. Frances Emery, Jean Moony and Louise Yeates also stated <br />their objections. Chester Whitte, the applicant, explained to Council <br />their intended use of the property. He stated that the American <br />Lutheran Church no longer objected to the zoning change request and <br />asked for a postponement on the first reading. The r1ayor then <br />closed the public hearing. Mr. Cavazos moved to approve the Ordinance <br />on first reading. Mrs. Norris seconded the motion. Mr. Brown moved <br />to table the Ordinance, but did not receive a second. On the <br />original motion to approve, the following vote was recorded: <br /> <br />AYE: Cavazos, James, Kraus, Norris, Stokes, Tarbutton <br /> <br />NAY: None <br /> <br />ABSTAIN: Brown <br />
