<br />I <br /> <br />I <br /> <br />I <br /> <br />11 <br /> <br />. <br /> <br />. <br /> <br />THE STATE OF TEXAS <br /> <br />I <br />I <br /> <br />COUNTY OF HAYS <br /> <br />REHABILITATION CONTRACT <br />AND GENERAL CONDITIONS <br /> <br />This Agreement, made and entered into this 8th day of <br />December , 19 80A.D., by and between GuadalUpe Lo~ez <br />and the Clty of San Marcos, hereinafter called the "Owner' <br />in consideration of the mutual premises and agreements <br />contained herein, the undersigned Contractor and Owner agree <br />as follows: <br /> <br />GENERAL CONDITIONS <br /> <br />1.. The bid shall be accepted or rejected by the owner <br />within 30 days from the date established by the City for the <br />receipt of the bid. This contract is subject to a Proceed <br />Order and no work shall be commenced by the Contractor until <br />he has received a Proceed Order. <br /> <br />2. The Owner is obligated to issue a written Proceed <br />Order within 30 calendar days from the date of acceptance of <br />the Contractor's bid. If the order is not received by the <br />Contractor within this period, the Contractor has the option <br />of withdrawing his bid. <br /> <br />3. The Contractor will commence work within 5 calendar <br />days of the issuance of the Proceed Order, and will satis- <br />factorily complete the work wlthln 60 calendar days after <br />execution of contract agreement. <br /> <br />4. Payment for the work performed shall be in one lump <br />sum after the work is satisfactorily completed. The City <br />may make progress payments if such payments, in the opinion <br />of the City, are necessary for the satisfactory completion <br />of the project. <br /> <br />5. The Contractor shall make no change in the work of <br />rehabilitation, provide any extra or additional work, or <br />supply additional labor, services, or materials beyond that <br />actually required for execution of the Contract, unless in <br />pursuance of a written order from the City of San Marcos <br />authorizing the change. No claim for an adjustment of the <br />Contract Price will be valid unless so ordered; and at the <br />time this claim is presented for payment, it must be accom- <br />panied by the authorized change order. The Owner may not <br />make changes in the work required to be performed by the <br />Contractor, and all work authorized by the Owner, and not <br />required under the Contract agreement, is the responsibility <br />of the Owner. <br /> <br />6. The Contractor guarantees the work performed for a <br />period of one year from the date of final acceptance of all <br />the work required by the Contract. Furthermore, Contractor <br />shall furnish the Owner, c/o San Marcos Community Development <br />Department, with all manufacturers' and suppliers' written <br />guarantees and warranties covering materials and equipment <br />furnished under the contract. The Contractor warrants that <br />all materials, fixtures, and equipment furnished by the <br />Contractor and his subcontractors shall be new, of good <br />quality, and of good title, and that the work will be done <br />
