THE STATE OF TEXAS I I COUNTY OF HAYS REHABILITATION CONTRACT AND GENERAL CONDITIONS This Agreement, made and entered into this 8th day of December , 19 80A.D., by and between GuadalUpe Lo~ez and the Clty of San Marcos, hereinafter called the "Owner' in consideration of the mutual premises and agreements contained herein, the undersigned Contractor and Owner agree as follows: GENERAL CONDITIONS 1.. The bid shall be accepted or rejected by the owner within 30 days from the date established by the City for the receipt of the bid. This contract is subject to a Proceed Order and no work shall be commenced by the Contractor until he has received a Proceed Order. 2. The Owner is obligated to issue a written Proceed Order within 30 calendar days from the date of acceptance of the Contractor's bid. If the order is not received by the Contractor within this period, the Contractor has the option of withdrawing his bid. 3. The Contractor will commence work within 5 calendar days of the issuance of the Proceed Order, and will satis- factorily complete the work wlthln 60 calendar days after execution of contract agreement. 4. Payment for the work performed shall be in one lump sum after the work is satisfactorily completed. The City may make progress payments if such payments, in the opinion of the City, are necessary for the satisfactory completion of the project. 5. The Contractor shall make no change in the work of rehabilitation, provide any extra or additional work, or supply additional labor, services, or materials beyond that actually required for execution of the Contract, unless in pursuance of a written order from the City of San Marcos authorizing the change. No claim for an adjustment of the Contract Price will be valid unless so ordered; and at the time this claim is presented for payment, it must be accom- panied by the authorized change order. The Owner may not make changes in the work required to be performed by the Contractor, and all work authorized by the Owner, and not required under the Contract agreement, is the responsibility of the Owner. 6. The Contractor guarantees the work performed for a period of one year from the date of final acceptance of all the work required by the Contract. Furthermore, Contractor shall furnish the Owner, c/o San Marcos Community Development Department, with all manufacturers' and suppliers' written guarantees and warranties covering materials and equipment furnished under the contract. The Contractor warrants that all materials, fixtures, and equipment furnished by the Contractor and his subcontractors shall be new, of good quality, and of good title, and that the work will be done
