<br />39 <br /> <br />AGREEMENT FOR MUTUAL AID IN FIRE PROTECTION <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />This Agreement is made on March 2 , 1999, by and between the City of San <br />Marcos (the "City"), a Texas municipal corporation that provides fire protection services within the <br />city limits of the City, and the South Hays County Fire Department, Inc. (the "SHCFD"), a Texas <br />non-profit corporation that provides fire protection services within the geographic area (the "SHCFD <br />Area") of the South Hays County Emergency Services District #3, as that area now exists or may be <br />changed in the future. <br /> <br />Section 1. Purpose <br />The purpose of this Agreement is to secure to citizens ofthe City and to citizens residing in <br />the SHCFD Area the benefits of mutual aid in firefighting and the protection of life and property <br />from fire. <br /> <br />Section 2. Provision of Assistance by City <br />In the event of a fire or fires within the SHCFD Area, then, upon request by the SHCFD's <br />on-duty supervisor to the City Fire Department's on-duty supervisor, the San Marcos Fire <br />Department will dispatch its firefighting equipment, if available and in good working order, and <br />personnel, if available, to any point within the SHCFD Area. <br />Section 3. Provision of Assistance by SQuth Hays County Fire Department <br />In the event of a fire or fires within the City, then, upon request by the City Fire Department's <br />on-duty supervisor to the SHCFD's on duty supervisor, the SHCFD will dispatch its firefighting <br />equipment, if available and in good working order, and personnel, if available, to any point within <br />the City. <br /> <br />Section 4. Requests for Assistance <br />Requests for assistance under this Agreement are subject to the following conditions: <br />A. A request for assistance shall include a statement of the amount and type of equipment and <br />number of personnel requested, and shall specify the location to which the equipment and <br />personnel are to be dispatched; but the amount and type of equipment and number of <br />personnel to be furnished shall be determined by the responding organization. <br />
