The officer in charge of the responding organization shall report to the officer in charge of <br />the requesting organization at the location to which the equipment is dispatched. <br />C. A responding organization shall be released by the requesting organization when the services <br />of the responding organization are no longer required, or when the officer in charge of the <br />responding organization determines the responding organization is needed within its own fire <br />protection area. <br /> <br />Section 5. Insurance, Waiver, Immunity <br />Each party agrees to maintain liability insurance in effect covering damage or injury to third <br />parties that may result from its operations under this agreement, and casualty insurance covering its <br />equipment used for operations under this agreement. Each party waives all claims against the other <br />party for compensation for any loss, damage, personal injury, or death occurring as a consequence <br />of the performance of obligations under this agreement. Neither party waives any immunity afforded <br />it under law related to the performance of its functions under this Agreement. <br />Section 6. Miscellaneous <br />A. Neither party shall be reimbursed by any other party for any expenses and costs incurred <br />under this Agreement. <br />B. All equipment used by the City Fire Department in carrying out this Agreement will be <br />owned by it, and all personnel acting for the City Fire Department under this Agreement will be <br />either an employees or volunteer members of the City Fire Department and acting in the scope ofthat <br />employment or assigned volunteer duty. <br />C. All equipment used by the SHCFD in carrying out this Agreement will be owned by it, <br />and all personnel acting for the SHCFD under this Agreement will be either an employee or <br />volunteer member of the SHCFD and acting in the scope of employment or assigned volunteer duty. <br />D. Either party to this Agreement may terminate this Agreement upon 30 days written notice. <br /> <br />Executed in duplicate originals on March 2 <br /> <br />,1999. <br />
