<br />59 <br /> <br />RESOLUTION 1999- 53 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THEASSIGNMENT OF <br />A CABLE TELEVISION POLE ATTACHMENT AGREEMENT <br />FROM TCI CABLEVISION OF TEXAS, INC. TO TIME <br />WARNER ENTERTAINMENT-ADVANCE/NEWHOUSE <br />PARTNERSHIP; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On January 22, 1990, the City Council approved an "Agreement to Make <br />Attachments of Television Cable and Necessary Appurtenant Facilities to Poles" (the <br />"Agreement") between the City and Karnack Cable TV. <br /> <br />2. The Agreement was subsequently assigned by the Karnack Corporation to TCI <br />Cablevision of Texas, Inc. (''TCI''). <br /> <br />3. TCI has requested City approval of the assignment of the Agreement from TCI <br />to Time Warner Entertainment-Advance/Newhouse Partnership ("Time Warner") in <br />connection with the transfer of the local cable television system from TCI to Time Warner. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The assignment of the Agreement from TCI to Time Warner is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the attached <br />letter indicating the City's consent to this assignment. <br /> <br />PART 3.
