RESOLUTION 2012 -25 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, CALLING FOR THE CONVENING OF A PUBLIC <br />TRANSPORTATION CONFERENCE PURSUANT TO THE PROVISIONS <br />OF CHAPTER 458 OF THE TEXAS TRANSPORTATION CODE; <br />AUTHORIZING THE POSTING OF NOTICE OF THE DATE, TIME AND <br />PLACE FOR THE CONFERENCE; AUTHORIZING THE CITY <br />MANAGER TO TAKE ALL NECESSARY ACTION RELATED TO THE <br />CONFERENCE IN ACCORDANCE WITH CHAPTER 458 OF THE <br />TEXAS TRANSPORTATION CODE ON BEHALF OF THE CITY; <br />AUTHORIZING THE MAYOR TO APPOINT AN ELECTED OFFICIAL <br />TO REPRESENT THE CITY OF SAN MARCOS AT THE CONFERENCE; <br />AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The cities of San Marcos and Kyle are likely to become a new "small urbanized <br />area" when the results of the 2010 U.S. Census become official in the spring of 2012. <br />2. The Capital Area Rural Transportation District ( "CARTS ") currently provides <br />fixed route services within the City of San Marcos and general demand response public transit <br />access to the citizens of San Marcos. <br />3. With the change in census status from rural to small urban will preclude CARTS <br />from providing services within the new urbanized area using existing federal and state rural <br />transit funding. <br />4. This census designation would enable the City of San Marcos to become a new <br />Federal Transit Administration ( "FTA ") designated recipient and grantee with direct access to <br />FTA Section 5307 formula funding to support transit. <br />5. This census designation requires that the new small urbanized area become a new <br />Urban Transit District in order to secure direct state transit funding. <br />6. The cities of San Marcos and Kyle, and the Texas State University -San Marcos <br />have recently entered into a Tri -Party Agreement to pursue the potential expansion of the <br />existing Texas State University -San Marcos Student Shuttle system into a public transit system <br />to serve the City of San Marcos and areas within the new "small urbanized area." <br />7. The new Tri -Party Agreement supports the desire to create a new Urban Transit <br />District, pursuant to the provisions of Chapter 458 of the Texas Transportation Code, to facilitate <br />the planning, development, and funding of public transit improvements, and stakeholder <br />involvement and consensus in achieving overall public transit service objectives. <br />1 <br />
