<br />129 <br /> <br />THE STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />FLOOD MITIGATION ASSISTANCE AGREEMENT <br />COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM <br /> <br />THISAGREEMENT, is made this 13th dayof April ,1999, between the City <br />of San Marcos, Texas, 630 East Hopkins, San Marcos, Texas (the "City"), and <br />(the "Subrecipient"). <br /> <br />The City has been awarded grant funds which may be spent by the City for the <br />provision of certain services authorized under the U.S. Department of Housing and Urban <br />Development ("HUD") Community Development Block Grant ("CDBG") Program; and <br /> <br />The City wishes to assist the Subrecipient in mitigating the effects of the October <br />1998 flood on the Subrecipient's residence located at , <br />San Marcos, Texas (the "residence") by providing funds to assist the Subrecipient, its <br />materials supplier or its contractor (as applicable) for materials and equipment to be utilized <br />in the mitigation effort as specified in the attached Statement of Work (Exhibit "A"). <br /> <br />Now therefore, the City and Subrecipient agree as follows: <br /> <br />ARTICLE 1 <br />GENERAL REQUIREMENTS <br /> <br />1.1 The City will reimburse the Subrecipient or pay a contractor in the amount stated in <br />the Statement of Work but in no event will the City reimburse more than the following: <br /> <br />Assistance to raise mobile homes - $5,000.00 maximum <br />Assistance to raise houses on pier and beam - $15,000.00 maximum <br />Assistance to raise houses constructed on monolithic slabs - $25,000.00 <br />Surveying costs to verify flood plain elevation/compliance certificate -$1 ,000.00 per <br />house/mobile home maximum <br />Purchase of lot/structure (as is) - $15,000.00 maximum <br />Assistance with demolition costs (home to be removed) - $5,000.00 maximum <br />Assistance with raising services to a newly elevated house - $2,000.00 maximum <br />Assistance with moving the house to a lot located outside of the flood plain <br />$15,000.00 maximum <br /> <br />In no event will the City reimburse more than the above stated maximums. Grant funds <br />will not be used to pay the Subrecipient or members of the Subrecipient's immediate family <br />for labor. <br /> <br />1 <br />
