<br />1.2 In the event that a building permit is required, all work performed under this <br />Agreement must be inspected and found to be satisfactorily completed by the City's <br />Building Inspector(s). Any work performed under this Agreement not requiring a building <br />permit, must be verified as complete by the City's Community Development Coordinator. <br />The Subrecipient is responsible for correcting any deficiencies found by the City's Building <br />Inspector(s). Failure to correct any noted deficiency will be considered a breach of contract <br />and Subrecipient will not be reimbursed by the City for the work not in compliance. <br /> <br />1.3 The Subrecipient will not deviate from the work described in the Statement of Work <br />without written authorization from the City. Any such deviation will be included in an <br />amendment to this Agreement. <br /> <br />1.4 The Subrecipient will ensure that all work specified in the Statement of Work is <br />satisfactorily completed within 180 days from the effective date of this Agreement. <br /> <br />ARTICLE 2 <br />SUBRECIPIENT'S RESPONSIBILITIES <br /> <br />The Subrecipient certifies that: <br /> <br />2.1 Subrecipient will utilize the grant funds it receives under this Agreement to perform <br />the services identified in the Statement. of Work in compliance with all the terms and <br />conditions specified in this Agreement and the City of San Marcos Flood Mitigation <br />Assistance Program guidelines. <br /> <br />2.2 Subrecipient is qualified for grant funding under the Low to Moderate Income <br />guidelines as set forth in Section 8 Income Limits established and amended annually by <br />HUD (Exhibit "D"). <br /> <br />2.3 Subrecipient has been the owner(s) of the residence for at least six months prior to <br />the submission of Subrecipient's application for flood mitigation assistance. <br /> <br />2.4 The residence is located within the 100 year flood plain as defined on the most <br />recent flood insurance rate maps, produced by the Federal Emergency Management <br />Agency. <br /> <br />2.5 The Subrecipient has sufficient flood insurance or will purchase such insurance. In <br />the case of a mobile home, the Subrecipient will show that its insurance covers floods in <br />the event the Subrecipient intends to remain on the lot. <br /> <br />2.6 All property taxes on the property are paid up to date, including City, County and <br />applicable School District Taxes. <br /> <br />2.7 The residence is not under a Contract for Deed, or any similar purchase agreement, <br /> <br />2 <br />
