<br />1 Section 4.17 - Prudent Industry Practices. GBRA shall utilize Prudent Industry Practices <br />2 under the Contract, among other things, to enhance but in no event displace, the Contract <br />3 Standards. In the event that, over the course of the Term of the Contract, Prudent Industry <br />4 Practices evolve in a manner which in the aggregate materially and adversely affect the cost <br />5 of compliance therewith by GBRA, GBRA shall be relieved of its obligation to comply with <br />6 the evolved Prudent Industry Practices (but not Prudent Industry Practices as ofthe Contract <br />7 Date) unless the City agrees to adjust the Service Fee in accordance with section 6.07 of this <br />8 Contract to account for the additional costs. Except to the extent that GBRA is relieved of <br />9 its obligation to comply with the evolved Prudent Industry Practices, as provided above, in <br />10 no event shall any evolution of Prudent Industry Practices, or any City election to payor not <br />II pay any such additional costs, relieve GBRA of any other obligations under this Contract. <br />12 <br />13 Section 4.18 - Safety Standards. All items or services supplied for this Project must <br />14 comply with the current Applicable Law, City of San Marcos building regulations and fire <br />15 prevention code, and chemical and materials handling instructions provided by <br />16 manufacturers and suppliers of chemicals. <br />17 <br />18 Section 4.19 - Drug Free Workplace Policy; Accident Reports. GBRA shall adopt and <br />19 enforce a zero tolerance drug-free workplace policy for the Project. GBRA shall make a <br />20 preliminary report to the City within 24 hours of any accidents related to the Project. GBRA <br />21 will forward to the City follow-up reports, as required by GBRA's safety, health and <br />22 substance abuse policies and insurance requirements, as they are completed. <br />23 <br />24 Section 4.20 - Public Education and Good Neighbor Policy. <br />25 A. GBRA shall prepare and keep current a comprehensive information brochure, <br />26 regarding the Project, subject to review and approval by the City, and make sufficient copies <br />27 available for all reasonable public information purposes. GBRA shall also conduct <br />28 educational tours of the Project for the public as reasonably requested by the City. <br />29 B. GBRA shall be responsible for operating and maintaining the Project in a manner <br />30 which maintains a positive public image. GBRA shall maintain the Project site and facilities <br />31 to present a clean, well maintained, pleasing appearance. GBRA shall be responsible for <br />32 responding to complaints regarding the maintenance and appearance of the Project in a <br />33 prompt and timely manner. Landscaping and landscape irrigation shall be used to enhance <br />34 the appearance of the Project. <br />35 <br />36 Section 4.21 - Project Security. <br />37 A. GBRA is responsible for securing the Plant and Project site from acts of <br />38 vandalism, trespass, and terrorism. GBRA shall report breaches in security and threats of <br />39 such breaches to the City Manager and to the San Marcos Police Department immediately <br />40 upon discovery. GBRA will conduct an annual review ofPwject security with the City to <br />41 identify areas of risk and measures for improving security. <br />42 B.
