<br />I Section 4.13 - Permits and Approvals. GBRA is responsible for applying for, obtaining, <br />2 and maintaining in force all permits and approvals, on behalf of the City as applicant, <br />3 required for the operation of the Project. The City shall have the right, but not the obligation, <br />4 to participate in the permitting process. GBRA shall coordinate with either the City or others <br />5 as necessary for obtaining any such approvals. GBRA shall bear all the costs associated with <br />6 such permits and approvals. <br />7 <br />8 Section 4.14 - Information. GBRA shall maintain, and provide the City access to aU <br />9 information systems, computer information, meters, operating data and financial books and <br />10 records related to the Project, and provide copies thereof to the City on request. <br />11 <br />12 Section 4.15 - Monthly Reports. GBRA shall provide reports to the City as described in <br />13 Article 11 ofthe Contract. Additionally, GBRA shall provide monthly reports to the City <br />14 relating to the quality and characteristics of raw and treated water, the quantity and type of <br />15 chemicals and agents used in the treatment of water and dewatering of residuals, the quantity <br />16 of backwash water discharged and the quantity of backwash water returned to the process, <br />17 inspections conducted, correspondence and contact with regulatory agencies, maintenance <br />18 and other matters. Annual summaries of such data shall be provided, together with audited <br />19 annual Project financial reports. <br />20 <br />21 Section 4.16 - Insurance and Indemnity. <br />22 A. GBRA shall maintain the following insurance coverages in full force and effect <br />23 throughout the term of this Contract at its sole expense: <br />24 1. Workers' compensation insurance in compliance with all Applicable Law; <br />25 2. Employer's liability insurance with a limit of at least $1,000,000; <br />26 3. Commercial general liability insurance including contractual liability, <br />27 completed operations and independent contractor's liability, with a combined <br />28 single limit of at least $10,000,000 for each occurrence; <br />29 4. Motor vehicle liability insunmce including owned, hired, leased and non- <br />30 owned vehicles, with a combined single limit of at least $3,000,000 for each <br />31 occurrence. <br />32 The City and GBRA shall both be named as insureds on the general liability coverage and <br />33 on the motor vehicle liability coverage. <br />34 B. GBRA shall hold harmless, indemnify and defend the City and its officers, agents <br />35 and employees from all claims, demands, causes of action, suits and regulatory actions and <br />36 related costs and expenses, including the costs of all investigations, judgments, settlements, <br />37 fines, forfeitures, attorney's fees and expert witness fees, related to GBRA's activities or <br />38 performance under this Contract. This obligation extends to contamination of or adverse <br />39 effects on the environment, and any violation or alleged violation of Applicable Law.
