I Section 4.13 - Permits and Approvals. GBRA is responsible for applying for, obtaining, 2 and maintaining in force all permits and approvals, on behalf of the City as applicant, 3 required for the operation of the Project. The City shall have the right, but not the obligation, 4 to participate in the permitting process. GBRA shall coordinate with either the City or others 5 as necessary for obtaining any such approvals. GBRA shall bear all the costs associated with 6 such permits and approvals. 7 8 Section 4.14 - Information. GBRA shall maintain, and provide the City access to aU 9 information systems, computer information, meters, operating data and financial books and 10 records related to the Project, and provide copies thereof to the City on request. 11 12 Section 4.15 - Monthly Reports. GBRA shall provide reports to the City as described in 13 Article 11 ofthe Contract. Additionally, GBRA shall provide monthly reports to the City 14 relating to the quality and characteristics of raw and treated water, the quantity and type of 15 chemicals and agents used in the treatment of water and dewatering of residuals, the quantity 16 of backwash water discharged and the quantity of backwash water returned to the process, 17 inspections conducted, correspondence and contact with regulatory agencies, maintenance 18 and other matters. Annual summaries of such data shall be provided, together with audited 19 annual Project financial reports. 20 21 Section 4.16 - Insurance and Indemnity. 22 A. GBRA shall maintain the following insurance coverages in full force and effect 23 throughout the term of this Contract at its sole expense: 24 1. Workers' compensation insurance in compliance with all Applicable Law; 25 2. Employer's liability insurance with a limit of at least $1,000,000; 26 3. Commercial general liability insurance including contractual liability, 27 completed operations and independent contractor's liability, with a combined 28 single limit of at least $10,000,000 for each occurrence; 29 4. Motor vehicle liability insunmce including owned, hired, leased and non- 30 owned vehicles, with a combined single limit of at least $3,000,000 for each 31 occurrence. 32 The City and GBRA shall both be named as insureds on the general liability coverage and 33 on the motor vehicle liability coverage. 34 B. GBRA shall hold harmless, indemnify and defend the City and its officers, agents 35 and employees from all claims, demands, causes of action, suits and regulatory actions and 36 related costs and expenses, including the costs of all investigations, judgments, settlements, 37 fines, forfeitures, attorney's fees and expert witness fees, related to GBRA's activities or 38 performance under this Contract. This obligation extends to contamination of or adverse 39 effects on the environment, and any violation or alleged violation of Applicable Law.
