<br />25. <br /> <br />ELECTRIC LINE EASEMENT <br /> <br />Date: <br /> <br />Grantor: City of San Marcos, 630 E. Hopkins, San Marcos, Hays County, Texas 78666 <br /> <br />Grantee: Bluebonnet Electric Cooperative, Inc., P.O. Box 240, Giddings, County, TX 78942-0240 <br /> <br />Consideration: Ten Dollars ($10.00) and other valuable consideration. <br /> <br />Property: A strip of land situated within the William Pettus Two Leagues, Abstract 21, Caldwell <br />County, Texas, as described in the attached Exhibit A which is fully incorporated herein by <br />reference. <br /> <br />Reservations from and Exceptions to Conveyance and Warranty: All easements, encumbrances, <br />rights of possession and other matters of record in Caldwell County, Texas, or visible and apparent <br />on the ground that a complete and correct survey would reveal. <br /> <br />Grantor, for the consideration, grants, sells and conveys to the Grantee an easement in the property <br />for the purpose of constructing, reconstructing, relocating, installing, operating and maintaining an <br />electric distribution line or system, telecommunications system and related appurtenances and <br />equipment (the "Electric Line") to provide service to the Grantee's surface water treatment plant <br />property. Grantor binds Grantor and Grantor's heirs, executors, administrators, successors to warrant <br />and forever defend this easement to Grantee and Grantee's successors and assigns against every <br />person whomever lawfully claiming or to claim the same or any part thereof, when the claim is by, <br />under or through Grantor, but not otherwise. <br /> <br />This easement shall automatically terminate without the necessity of further action by the Grantor <br />when the Electric Line is abandoned by Grantee, or ceases to be used for a period of 12 consecutive <br />months. <br /> <br />This conveyance is made by Grantor and accepted by Grantee expressly subject to the following <br />express reservations, covenants and conditions: <br /> <br />1. Grantor retains, reserves, and shall continue to fully enjoy the use of the easement area for any <br />and all purposes that do not interfere with and prevent Grantee's use of the easement for its intended <br />purpose. <br /> <br />2. Grantor reserves the right to construct and install fencing, driveways, curbing, pavement, and <br />other similar improvements, and other utilities that do not interfere with the Electric Line, within the <br />easement. Grantee agrees at its sole expense to repair or replace any such improvements that are <br />damaged or temporarily moved during any construction, maintenance or operating activity of <br />Grantee. Grantee agrees to promptly restote all areas of the easement after the completion of any <br />construction, maintenance or operating activity to a condition substantially equivalent to their <br />condition prior to the activity. <br />
