CITY OF SAN MARCOS ELECTRIC RULES AND REGULATIONS rendered or performed and any and all tliiiigs furnished or supplied and ally and all facilities used furnished, or supplied by the City_ Service Agreement. A written agreement between the City and Customer pursuant to which Service is supplied and taken. The Service Agreement is made Subsequent to, or as part of an Application for Service. In _this agreement, unless otherwise specifically agreed to by the City, the Customer agrees to be bound by the terms of the Rules and Regulations applying to retail electric service as well as the City's other applicable policies and procedures. the Electric Service. Standards and any applicable Rate Schedule(s) as they exist, and as amended. APPLICATION FOR SERVICE Electric service supplied by the City will be 60 -cycle alternating current delivered at the available standard voltages adjacent to the premises where the customer is located. Secondary service will be supplied at nominal voltages of 120/240 volt single phase, three phase voltages of 120/208 volt, 120/240 volt, 277/480 volt, and 240/480 volts, or such other voltage as is available. Primary service will be supplied at nominal voltage below 15,000 volts as available. The City will provide electric service and administer these Rules and Regulations. Before purchasing or installing electrical equipment and/or wiring, the customer should secure information in writing from the City as to the type of service available at the location to be served. CONTINUITY OF SERVICE The city does not guarantee, but with the cooperation of the customer, will endeavor to furnish a continuous supply of electric power and energy and to maintain voltage and frequency ., ithiH f-easonable limipi but does not guarantee the service against an irregularity, fluctuation or interruption. The City may interrupt a customer's service when necessary to repair, change, or relocate the City's equipment and facilities. The City is not liable for dama -,c resulting from interrupted service for repair, change. or relocation. LIMITATION ON CITY'S LIABILITY; RELEASE. applianees Of f the pr-()pe!4yofl the ;to A. The City is not liable to a customer or to any other person, for property damage, personal injury, business damage. whether direct or consequential, or other loss resulting from a power black -out, power brown -out, interruption or failure of electric service, delay in commencing service low voltage, hi,h voltage, power surges, or fluctuation of power voltage, wave form, or frequency, caused by a negligent or non - negligent act of the City except for gross negligence or intentional misconduct. B. A customer shall release and hold the City harmless for an dy amage. injury or loss described in this section.
