CITY OF SAN MARCOS ELECTRIC RULES AND REGULATIONS <br />If service is not connected or after disconnection of service, the City shall <br />promptly and automatically refund the customer's deposit in excess of unpaid bills <br />for service furnished. <br />DISCONTINUANCE OF SERVICE <br />A. Customer's Request <br />A customer may request service to be discontinued during regular business hours. <br />The customer is responsible for any use of the electric service until the City has <br />had a reasonable time to secure a final reading or to remove the meter. <br />B. Non - Payment of Bills or Non - compliance with Service Contract <br />The due date of the bill for utility service shall be the fi eighteenth (148th) <br />day following the date of issuance of the bill. A bill for utility service is <br />delinquent if unpaid by the due date. The penalty date for all bills shall be the <br />*° eighteenth (2- 18th) day following the date of issuance. Any and <br />all amounts not paid before the penalty due date shall be assessed a charge in the <br />amount of t en per cent (10 %) of the unpaid amount. <br />Service may be disconnected for non - payment if a termination notice is given <br />after the due date and twenty -fie 6 ht (?S 28) days have elapsed from the date <br />of issuance of the bill. Payment is considered to be received when it reaches the <br />offices of the city. <br />Service may be discontinued by the city for failure of the customer to pay bills in <br />accordance with the provisions stated herein under "Payment of Bills" or to <br />comply with their terms of the service contract, -c}r these Rules and Regulations= or <br />the applicable rate schedule. <br />Service will not be disconnected provided a physician contacts the City' s electric <br />utility office before the due date and certifies in writing, within ten (10) days after <br />the due date, that discontinuance of service will result in someone at that resident <br />becoming seriously ill or more seriously ill. <br />C. Misrepresentation. <br />The City may discontinue service without notice upon the discovery that the <br />customer has made a misrepresentation to the City regarding the use of an electric <br />service or has in any manner fraudulently entered into the service contract. <br />D. Unlawful Use of Service <br />(1) Service may be discontinued if the electric power and energy is obtained <br />in a manner defined in Section 31.04 of the Texas Penal Code as <br />amendeda or in an unlawful manner as determined by any <br />governmental body having jurisdiction. Compliance with any such <br />determination, order, or directive will relieve the city from any liability <br />associated with the discontinuance of service. Payment of all amounts for <br />which the City has not been compensated, including interest and other <br />charges incurred in rendering service to the customer whether or not <br />5 <br />
