<br />44 <br /> <br />OFFICE OF THE MAYOR <br />CITY OF SAN MARCOS. TEXAS <br />DECLARATION OF LOCAL DISASTER <br /> <br />WHEREAS, on May 28, 1999, the City of San Marcos has been informed by the Texas Natural <br />Resource Conservation Commission (TNRCC) that the Spring Lake Dam (the Dam) is in imminent <br />danger of collapsing, and <br /> <br />WHEREAS, the imminent danger of collapse of the Dam creates an imminent threat of widespread or <br />severe damage, injury, or loss of life or property from water flows that would be created in and near the <br />San Marcos River from the collapse, and, <br /> <br />WHEREAS, the Texas emergency management statute (Government Code Chapter 418) defines the <br />term "disaster" as including "the imminent threat of widespread or severe damage, injury, or loss of life <br />or property"; and <br /> <br />WHEREAS, the Mayor Pro-Tern of the City of San Marcos has determined that extraordinary measures <br />must be taken to prevent injuries to persons or property within the City; <br /> <br />NOW, THEREFORE, BE IT DECLARED BY THE MAYOR PRO-TEM OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />Section 1. That a state of disaster is declared within the City of San Marcos. <br /> <br />Section 2. That the City's Emergency Management Plan has been implemented. <br /> <br />Section 3. That the state of disaster shall continue for a period of not more than seven days of the date <br />hereof, unless the same is continued by consent of the City Council of the City of San Marcos, Texas. <br /> <br />Section 4.
