<br />A person is deemed to be camping when it reasonably appears, in the light of all the circumstances, <br />that the person is in fact using the area for living accOlnmodation purposes regardless of the intent <br />of the person or the nature of anv other activities in which the person may also be engaging. <br /> <br />Public area means an outdoor area to which the public or a substantial group of the public <br />has access and includes, but is not limited to, streets. highways, parks, parking lots. allevways, <br />pedestrian ways, and the common areas of schools, hospitals, apartment houses, office buildings, <br />transportation facilities, shops and highway or utility rights-of-way. <br /> <br />Sec. 34.101. Bathin~ in or dama~in2 any public fountain. reservoir. lake. stream or <br />river. <br /> <br />It is unlawful for any person to interfere with any public well, cistern, water plug. fountain, <br />river, or reservoir, or to bathe in any public reservoir or river. or tributaries thereof, or to in any <br />manner deface or iniure the same, or to take or use water from any public reservoir or river without <br />proper authority from the Texas Natural Resource Conservation Commission. <br /> <br />Sec. 34.102. Urinating or defecating in public areas. <br /> <br />(a) A person commits an offense ifhe or she urinates or defecates: <br /> <br />ill In or on a public area: or <br /> <br />ill In a location yisible to persons in a public area. <br /> <br />(b) It is an affirmative defense to prosecution under this section if the person was in a <br />restroom. <br /> <br />Sec. 34.103. Beg2in~ in public areas. <br /> <br />ill It is unlawful for any person to aggressively beg or solicit money, donations of <br />money, property, or financial assistance of any kind in a public area. A person begs or solicits <br />money in an aggressive manner ifit is done in any of the following ways: <br /> <br />ill By coming within 3 feet of the person solicited, until that person has indicated that <br />he does wish to make a donation: <br /> <br />ill By blocking the path or interfering with passage of the person solicited along a <br />sidewalk or street; <br /> <br />ill Bv following a person who walks away from the beggar or solicitor: <br /> <br />ill By using profane or abusive language, either during the solicitation or following a <br />refusal; or <br /> <br />ill By any statement. gesture, or other communication which a reasonable person in the <br />situation would perceive to be a threat. <br /> <br />@ It is unlawful for any person to beg or solicit money. donations of money, property, <br />or financial assistance of any kind when the person solicited is: <br /> <br />ill At any bus stop or train stop: <br /> <br />ill In any public transportation vehicle or facility: <br /> <br />ill In any vehicle on a street; or <br /> <br />ill On private property, unless the beggar or solicitor has permission from the owner <br /> <br />6/10/99 Nuisance.ord.wpd <br /> <br />- 2 - <br />
