<br />or occupant. <br /> <br />~ It is unlawful for any person to beg or solicit money, donations of money, property, <br />or financial assistance of any kind in a public area between sunset and sunrise. <br /> <br />@ It is unlawful for any person to knowingly make a false or misleading representation <br />in the course of soliciting a donation. False or misleading representations include. but are not <br />limited to, the following: <br /> <br />ill Stating that the donation is needed to meet a specific need, when the solicitor <br />already has sufficient funds to meet that need and does not disclose that fact; <br /> <br />ill Stating that the donation is needed to meet a need which does not exist; <br /> <br />ill Stating that the solicitor is from out of town and stranded, when that is not true: <br /> <br />ill Wearing a military uniform or other indication of military service, when the solicitor <br />is neither a present or former member of the service indicated: <br /> <br />ill Wearing or displaying an indication of physical disability, when the solicitor does <br />not have the disability indicated: <br /> <br />@ Use of any makeup or deyice to simulate any deformity: or <br /> <br />ill Stating that the solicitor is homeless, when that is not true. <br /> <br />Sec. 34.104. Camping in public areas. <br /> <br />ill Except in areas designated by official signs for campinlZ purposes, it is unlawful to <br />camp in any public area. <br /> <br />@ Any personal property, tent. shelter, vehicle or other structure found in a public area <br />in violation of this section may be removed by a police officer or park ranger and stored at the <br />owner's eXIlense. <br /> <br />~ It is an affirmative defense to prosecution under this section if the person owns the <br />property, or has secured the written permission of the property owner to camp on the property. <br /> <br />Sec. 34,105. -- 34.125. Reserved. <br /> <br />SECTION 2. Chapter 34, Article 3, Division 2, of the San Marcos City Code is amended <br />by removing sections 34.100 - 34.125 as follows (underlining indicates added language; an <br />o v Clstlike indicates deleted language): <br /> <br />Sec. 34.082 -- 34.125 34.099. Reserved. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 5. Any person violating a provision of this ordinance commits a misdemeanor <br />and is subject upon conviction, in addition to other penalties provided by law, to the penalty <br />provided in Section 1.015 ofthe San Marcos City Code. <br /> <br />SECTION 6. This Ordinance takes effect 10 days after the date of its final passage, and <br />the City Secretary will publish notice of its adoption in a newspaper of general circulation in the <br /> <br />6/10/99 Nuisance.ord.wpd <br /> <br />- 3 - <br />
