<br />67 <br /> <br />MEMORANDUM OF UNDERSTANDING <br /> <br />This is a memorandum of understanding between the City of San Marcos, Texas (City) and <br />Southwest Texas State University (SWT) relating to cooperation and coordination of police services. <br />This memorandum of understanding supersedes the previous memorandum of understanding adopted <br />by the City on February 22, 1988. <br /> <br />1. Purpose <br /> <br />1.01. Both the City and SWT are authorized to commission peace officers with all the powers, <br />privileges and immunities authorized by law. <br /> <br />1.02. The purpose ofthis memorandum of understanding is to promote effective and efficient police <br />service within the City of San Marcos and on the campus of Southwest Texas State <br />University. The parties intend to provide for mutual aid, define primary territorial <br />responsibility, and coordinate services between their police departments. Nothing in this <br />memorandum shall be construed to limit the jurisdiction, powers, privileges or immunities <br />of the parties within their respective jurisdictions. <br /> <br />2. Term <br /> <br />2.01. This agreement will become effective July 1, 1999, and will continue in effect until either <br />party terminates the agreement by giving the other party ten days' written notice. <br /> <br />3. Authority and Areas of Operation <br /> <br />3.01. The City's Police Department has law enforc~ment authority over all areas within the City's <br />corporate limits, including those areas owned or controlled by SWT. SWT's peace officers <br />have authority over all areas within Hays County including those areas within the City's <br />corporate limits. <br /> <br />3.02. Ordinarily SWT's officers will confine their activities to the property owned, leased, or <br />controlled by SWT and to streets adjacent to such property. Likewise, ordinarily the City's <br />officers will confine their activities to areas within the city not owned, leased, or controlled <br />by SWT. However, officers from either entity may operate within the usual areas of the other <br />when responding to a request for assistance or while in the performance of their duties. <br /> <br />3.03. The City specifically authorizes SWT's peace officers to enforce ordinances found in the <br />following chapters of the City Code: <br /> <br />(a) <br />(b) <br /> <br />Chapter 6: <br />Chapter 58: <br /> <br />Animals. <br />Public Facilities, Parks, and Recreation. <br />
