<br />activity which would disturb or endanger the public, or harm the Leased Premises or adj acent <br />property . <br /> <br />Article 3. Maintenance of Leased Premises <br /> <br />3.1 The Co-op will maintain the Leased Premises at all times free of trash, debris and other <br />objectionable materials. VVhen not in use for cultivation, the Co-op will keep the Leased <br />Premises in a neat, mowed condition. The Co-op will promptly remove all garbage and <br />refuse of any kind from the Leased Premises. <br /> <br />3.2 The Co-op will comply at its sole cost and expense with all governmental laws, ordinances <br />and regulations applicable to the Leased Premises and to its use of the Leased Premises. <br /> <br />3.3 At the expiration of this Lease, the Co-op will surrender the Leased Premises in good <br />condition. <br /> <br />Article 4. Utilities <br /> <br />4.1 The Co-op will pay all charges for all utility and garbage services to the Leased Premises. <br />The City will provide reclaimed water for irrigation purposes to the Leased Premises, for <br />which the Co-op will pay to the City the City's standard reclaimed water rate. The initial <br />reclaimed water rate is 69~11 000 gallons. The Co-op will comply with all utility provider <br />policies and government regulations that apply to its use of utilities and reclaimed water on <br />the Leased Premises. <br /> <br />4.2 The City will not be liable to the Co-op for any interruption in utility services. <br /> <br />Article 5. Indemnity; Waiver <br /> <br />5.1 The Co-op agrees to defend, indemnify and hold harmless City from all damages, claims, <br />losses, demands, suits, judgments, and costs, including reasonable attorney's fees and <br />expenses arising out of the use of the Leased Premises by Co-op, its agents or members or <br />anyone for whose acts Co-op may be liable. <br /> <br />5.2 The City, and its officers, agents and employees will not be liable to the Co-op or its <br />members, and the Co-op on behalf of itself and its members waives any liability of the City <br />and its officers, agents and employees, for any personal injuries or property damage that may <br />be caused by the acts or omissions of the City or its officers, agents or employees. <br /> <br />Article 6. Default and Remedies <br /> <br />6.1 The following events will be deemed to be events of default by the Co-op under this Lease: <br /> <br />2 <br />
