<br />(1) The Co-op fails to comply with any term, provision, or covenant of this Lease, and does <br />not cure the failure within 10 days (the "Cure Period") after receipt of a written notice from <br />the City. <br /> <br />(2) The Co-op deserts or vacates any substantial portion of the Leased Premises. <br /> <br />6.2 Upon the occurrence of an event of default, the City will have the option to pursue any <br />remedy or remedies permitted by law without any notice or demand whatsoever, including <br />the entry upon the Leased Premises without being liable for prosecution or any claim for <br />damages, and do whatever the Co-op is obligated to do under the terms of this Lease. <br /> <br />6.3 The Co-op agrees to reimburse the City for any expenses which the City may incur in <br />effecting compliance with Co-op's obligations under this Lease. Pursuit of anyone or more <br />remedies will not preclude the City from pursuing any other remedies provided by law, nor <br />will pursuit of any remedies constitute a forfeiture or waiver of any rent due to the City, or <br />of any damages accruing to the City by reason of the violation of any of the terms of the <br />Lease. <br /> <br />6.4 If it will become necessary for the City to use an attorney to enforce or defend any of the <br />City's rights or remedies due to any breach or default by the Co-op in its obligations, the Co- <br />op agrees to pay reasonable attorney's fees incurred by the City. <br /> <br />Article 7. Term and Termination <br /> <br />7.1 The term of this Lease will be for a period of two years from its effective date. This Lease <br />will automatically renew for one year periods thereafter unless one party notifies the other <br />of its intention not to renew the Lease at least 30 days in advance of an anniversary of the <br />effective date. <br /> <br />7.2 Either party may terminate this Lease at any time and for any reason by giving 90 days <br />advance written notice. The notice will state the date of the termination. <br /> <br />7.2 In the event of a default by the Co-op that is not cured by the Co-'op within the Cure Period, <br />the City may terminate this Lease at any time upon written notice to the Co-op. <br /> <br />Article 8. Miscellaneous <br /> <br />8.1 If any clause or provision of this Lease is illegal, invalid or unenforceable under present or <br />future laws in effect during the term of this Lease, it is the intention of the parties that the <br />remainder of this Lease will not be affected. <br /> <br />8.2 This Lease may not be altered, changed, or amended, except by a written instrument signed <br />by both parties. <br /> <br />"l <br />.) <br />
