<br />to pay to Lessor all reasonable costs of removing the property and equipment if Lessee fails <br />to do so within the time specified above. <br />8. Notices: <br />All notices to Lessor shall be in writing and shall be sent by certified mail, return receipt requested, <br />or by confirmed fax, addressed to the City Manager ofthe City of San Marcos, 630 East Hopkins <br />Street, San Marcos, Texas 78666, Fax (512) 396-4656. All notices to Lessee shall be in writing and <br />shall be sent by certified mail, return receipt requested, or by confirmed fax, addressed to Sprint <br />Spectrum, L.P., 1341 W. Mockingbird Lane, Suite 600E, Dallas, TX 75247, Attn.: Site Development <br />Director, Fax (214) ~ ..25.1.11 ~.. . Either party may designate a different addressIF ax number for notice <br />by notifying the other party in writing. <br />9. Surrender of Leased Premises: <br />Lessee will quit and surrender the Leased Premises to Lessor at the expiration or any termination of <br />this Agreement peaceably, quietly and in as good order and condition as now exists, reasonable use <br />and wear and authorized improvements excepted. <br />10. Nondiscrimination: <br />The Lessee shall not discriminate against any employee or applicant for employment because of race, <br />religion, sex, color, national origin, age or physical handicap. The Lessee shall include a similar <br />provision in any subcontract it may enter into in connection with this Agreement. <br />11. Additional Payments by Lessee: <br />Lessee shall pay, in addition to the rental specified, all permit fees, license fees, and any and all taxes <br />required by law and/or by ordinances of the City of San Marcos, Texas, incurred or occasioned by <br />Lessee's installation, use, operation, maintenance and/or removal of Lessee's equipment at, on, or <br />from the Leased Premises. <br />12. Utilities: <br />Lessee shall provide all utility services used by Lessee in its own name and shall promptly pay all <br />bills for the services. <br />13. Hazardous Substances: <br />Lessor is not aware of the presence of hazardous substances on the Leased Premises; however, <br />Lessor makes no warranty to Lessee in this regard.
