house any animal under the care of the department without prior written <br />approval from the director. <br />(3) Ride, drive, or lead a saddle horse in a city park, except upon a designated <br />horseback riding trail, or designated horseback riding area, without a <br />permit from the director; of <br />(b) A person convicted of a violation of subsection 58.040(a)(1) is punishable by a <br />fine of not less than $200.00, but not more than $500.00, and of subsection <br />58.040(a)(2) by a fine of not less than $75.00, but not more than $500.00. <br />(c) Employees of the department Peace Officers, Rangers and emergency personnel <br />are exempt from this section to the extent that there is conflict with the discharge <br />of their official duties. <br />Section 58.041. Use of Barbeque Grills, Pits or other Cooking Appliances <br />(a) The Department Director may, in order to protect the public's health, safety or <br />welfare or preserve city park resources place restrictions on the use of Barbeque <br />grills containers or other cooking appliances in city parks and facilities by posting <br />notice at the main entrance of the facility, park, trail head or other conspicuous <br />location. <br />Sec. 58.042. Styrofoam Products Prohibited <br />(a) It is unlawful for any person to use carry, dispose, or possess Styrofoam products <br />in any city park or in or upon the waters of the San Marcos River.
