<br />locations should be included in the first Construction Contract. <br /> <br />1.3 TASK 2 - COST ESTIMATE <br /> <br />For all ten crossing locations the Engineer will: <br /> <br />1.3.1 Provide to the City a written statement of probable construction cost based upon <br />prevailing market conditions at the conclusion of the preliminary engineering and again <br />prior to the bidding of the Project. <br /> <br />1.4 TASK 3 - PERMITS <br /> <br />For all ten crossing locations the Engineer will: <br /> <br />1.4.1 Obtain right-of-way permits from the Union Pacific Railroad and the Texas <br />Department of Transportation ("TxDOT") on behalf of the City. <br /> <br />1.4.2 Prepare the necessary permit and/or license application(s) for the Union Pacific <br />Railroad, TxDOT, and the Texas Natural Resources Conservation Commission ("TNRCC"). <br /> <br />1.4.3 Conduct meetings or other communication with the various agencies to obtain <br />approvals. <br /> <br />TASK 4 - PREPARATION OF CONSTRUCTION DOCUMENTS <br /> <br />For two of the ten crossing locations ("Construction Contract #1 "), the Engineer will: <br /> <br />1.5.1 Prepare construction contract documents using forms supplied by the City based <br />on the approved design development documents and any further adjustments authorized <br />by the City in the scope, quality or budget of the Project. These contract documents will <br />include detailed plans and technical specifications required for the Project to be accurately <br />bid and efficiently constructed. <br /> <br />1.5.2 Use its best professional judgment to create documents that comply with applicable <br />construction and development codes, local regulations and ordinances and other federal <br />and state regulations which are known or which should reasonably be known to the <br />Engineer. <br /> <br />1.5.3 Be responsible for the printing and binding of 40 sets of the bid documents at no <br />additional cost to the City. <br /> <br />1.5.4 Ensure that no reports, maps, or other documents produced in whole or in part <br />under this Agreement shall be the subject of an application for copyright by or on behalf <br />of the Engineer. <br /> <br />4 <br />
