96. SAN MARCOS CENTER LEASE AGREEMENT THE STATE OF TEXAS COUNTY OF HAYS This Lease Agreement ("Lease"), made and entered into this 1st day of October, 1999_, with effective date provided below by and between San Marcos Center , hereinafter called "Lessor" and City of San Marcos I hereinafter called "Lessee". WIT N E SSE T H: That for and in consideration of the covenants, agreements and stipulations herein contained, Lessor does hereby demise and lease unto Lessee and Lessee does hereby take, rent and hire from Lessor for the term and upon the terms and conditions hereinafter set out, a lease space in The San Marcos Center Suites 103B and 104 (the "Shopping Center"). The tract upon which the Shopping Center is located is more particularly described on Exhibit "A" hereunto attached. The lease space hereby demised ("the Premises") is outlined in red on the plan of the Shopping Center attached hereto as Exhibit "B". All of said Exhibits have been initialed by the parties hereto and made a part hereof. Lessor reserves the right to place in, under, over or through the Premises all pipes, wires, lines and facilities serving other areas of the Shopping Center. FUNDAMENTAL LEASE PROVISIONS: Whenever the following terms appear in this Lease with their initialletter(s) capitalized, such use shall constitute a reference to the appropriate descriptions for such terms in this section. (a) Shopping Center (including street address): San Marcos Center 700 N. LBJ San Marcos, TX 78666 (b) Lessor [Landlord] (including mailing address): San Marcos Center c/o Lynx Property Services 2101 S. IH-35, Ste. 401A Austin, TX 78741 (c)Lessee [Tenant] (including mailing address): City of San Marcos 700 N. LBJ, Ste. 103B & 104 San Marcos, TX 78666 (d) Lessee's Business Name: City of San Marcos W.I.C. program (e) Premises: That portion of the Shopping Center identified and/or outlined in yellow on the plot plan attached hereto as Exhibit "B" and made a part hereof for all purposes, and containing approximately 3,730 square feet of rentable area. (f) Permitted Use: city office space or W.I.C. program administration and/or clinic. (g) Term: A period beginning on or before 10 business days after substantial completion of tenant finish out and certificate of occupancy has been obtained by landlorc~ at landlord's expense. The "Commencement Date" shall be 1 ~ business days after the certificate of occupancy is obtained by the landlord or physIcal occupancy by the Lessee, whichever occurs first, and shall terminate on the last day of the 60th calendar month after the Commencement Date (the "Termination Date"). 1 Lessee its Lessor {LkJ
