<br />144 <br /> <br />RESOLUTION 1999- 218 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING A UTILITY EASEMENT <br />FROM THE CRAWFORD F AMIL Y HISTORICAL MUSEUM, <br />INC. TO THE CITY FOR AN EXISTING CITY WATER LINE <br />AND THE HAYS ENERGY RECLAIMED WATER LINE; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />EASEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The Crawford Family Historical Museum, Inc., has claimed ownership of an old county <br />roadway by virtue of their longstanding use and maintenance of the area and abandonment by the <br />county, and the Crawford family is willing to recognize an easement for an existing City water line <br />through the area, and grant additional easement area for a reclaimed water line to be constructed <br />between the City's wastewater treatment plant and the new Hays Energy, L.P. power plant. <br /> <br />2. Unlike other easements being obtained by Hays Energy for the reclaimed water line, this <br />easement will be granted directly to the City because of the presence of the existing water line. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached City of San Marcos Utility Easement from the Crawford Family <br />Historical Museum, Inc. to the City is approved. <br /> <br />PART 2. The City Manager of the City of San Marcos, Larry D. Gilley, is authorized to <br />execute this easement on behalf of the City. <br /> <br />PART 3.
