Hopkins <br />San Marcos, Hays County, Texas 78666 <br /> <br />Consideration: TEN AND NO/lOa DOLLARS ($10.00) and other <br />valuable consideration. <br /> <br />Property (including any improvements): <br />An underground utility easement for municipal waterline and <br />wastewater line purposes, containing 1.36 acres, more or less, <br />being more particularly described by metes and bounds on Exhibit <br />"A" attached hereto and incorporated by reference herein. <br /> <br />The permanent easement granted herein shall be no greater than <br />Thirty-Five feet (35') in width and is hereinafter referred to as <br />the Permanent Easement Strip. <br /> <br />During the period of initial construction for said waterline and, <br />in any event, for a period of not more than One (1) year from the <br />date of the execution of this agreement, Grantee shall have the <br />right to use as a temporary construction easement of an <br />additional Sixty-Five foot (65') strip of land that lies adjacent <br />and parallel to the Permanent Easement Strip and two (2) <br />additional areas for boring purposes at the intersection of the <br />Permanent Easement Strip with the right of way line of State <br />Highway 123 and the intersection of the Permanent Easement Strip <br />with the right of way line of FM 3407 whereby Grantee will have a <br />total workspace (including Permanent Easement) at each bore site <br />of 200' by 200' (hereinafter the "Temporary Easement"), said <br />Temporary Easement being more particularly described on Exhibit <br />"B" attached hereto and incorporated by reference herein. <br /> <br />Reservations from and Exceptions to Conveyance and Warranty: <br />This easement is granted, subject to all encumbrances <br /> <br />1 <br />
