<br />Addendum to Section 3: <br /> <br />Notwithstanding any other provision of this ordinance, the consent and permit granted <br />herein does not constitute a franchise under the City Charter and the Agreed Settlement <br />Sum does not constitute a franchise payment under the City Charter. To the extent PG&E <br />wishes to lay new lines in City Rights-of-Way, or conduct future operations within City <br />Rights-of-Way other than a continuation of its existing facilities and operations as of the <br />effective date of this ordinance, PG&E agrees to submit a written request to the City, and <br />the City agrees to promptly consider the request. <br /> <br />PAGE 4 of 10 of <br />EXHIBIT A <br />
