<br />Section 2. Vacation and Abandonment of Easements. (a) The following described <br />easements are hereby permanently vacated and abandoned by the City and the general public: <br /> <br />(i) The thirty foot (30') ingress and egress easement shown on the recorded <br />plat of the Municipal Airport Subdivision and recorded in Volume 273, Page 605, <br />Hays County Deed Records; and <br /> <br />(ii) The twenty foot (20') roadway easement shown on the recorded plat of the <br />Municipal Airport Subdivision and as set out in a Deed of Dedication recorded <br />in Volume 163, Pages 160-164, Hays County Deed Records. <br /> <br />(b) To the extent, if any, that the City of San Marcos and the general public may have <br />any right title or interest in and to the following described easements, such right, title, interest <br />and easements are hereby permanently vacated and abandoned by the City and the general <br />public, to-wit: <br /> <br />(i) A twenty foot (20') right of way easement described in deed of record in <br />Volume 261, Pages 630-635 of the Deed Records of Hays County, Texas, said <br />easement also being the easement conveyed by, and described in Exhibit "B" to, <br />a Special Warranty Deed recorded at Volume 1400, Page 252, Hays County Deed <br />Records; <br /> <br />(ii) A thirty foot (30') and a fifty foot (50') easement described in deed of record <br />at Volume 261, Pages 630-635 of the Deed Records of Hays County, Texas, said <br />easement also being the easement conveyed by, and described in Exhibit "D" to, <br />a Special Warranty Deed recorded at Volume 1400, Page 252, Hays County Deed <br />Records; <br /> <br />(iii) A thirty foot (30') ingress and egress easement described in four parts as <br />Tracts A, B, D and E, in an instrument filed of record at Volume 907, Page 673, <br />of the Official Records of Hays County, Texas, said easement also being the <br />easement conveyed by, and described in Exhibit "C" to, a Special Warranty Deed <br />recorded at Volume 1400, Page 252, Hays County Deed Records; and <br /> <br />(iv) A fifty foot (50') easement described in a deed of record at Volume 845, <br />Page 800, of the Real Property Records of Hays County, Texas, said easement <br />also being conveyed by, and described in Exhibit "C" to, a Special Warranty <br />Deed recorded at Volume 1400, Page 252, Hays County Deed Records; and <br /> <br />The easements above referenced and described in this Section 2 are referred to collectively, in <br />this Ordinance, as the "Easements". <br /> <br />Section 3. Release. The City Manager, and the City Secretary, are hereby authorized, <br />empowered, instructed and directed to execute a Notice of Abandonment and Release (the <br /> <br />2 <br />
