<br />"Notice"), giving public notice that the City has vacated and abandoned the Easements, and that <br />the City releases the Easements and the rights and imerests of the City and the general public <br />in and to the Easements, and to file thc said Notice in the Official Public Records of Hays <br />County, upon the rcccipt of a Release. Waiver and Consent from, and executed by, W. C. <br />Carson, and Brian F. McCoy and wifc, Wetonnah L. McCoy, respectively. <br /> <br />Section 4. Roadwav Easement. Thc City .Manager, and the City Secretary, are hereby <br />authorized, empowered, instructed and directed to execute the Roadway Easement spread on the <br />minutes of this meeting, and to file the said Roadway Easement in the Official Public Records <br />of Hays County, upon the receipt of the Release. Waivcr and Consent from W. C. Carson. <br /> <br />Section 5. Dedication. The City Council hereby dedicates to the public as public right-of- <br />way for streets, drives, drainage, utility service. and public places, the following described tract <br />and parcel of land that abuts ROW herctofore dedicatcd by the City: <br /> <br />A 0.160 acre tract of land situated in thc J. M. Veramcndi League No. One, in <br />the City of San Marcos, Hays County, Texas, as more particularly described and <br />shown as Tract No.7 on Exhibit "A" attached to this Ordinance. <br /> <br />Section 6. No Obligation to Construct. )Jeither this Ordinance nor the execution and <br />delivery of any related instrument shall obligate the City in any manner to fund the construction <br />of, or to construct or extend, any public street. <br /> <br />Section 7. Effective Date. This Ordinance shall be in force and effect from and after its <br />passage on the date shown below. <br /> <br />Section 8. Open Meetings. It is hereby officially found and determined that this meeting <br />was open to the public. and public notice of the time, place and purpose of said meeting was <br />given, all as required by the Open Meetings Act, Chapter 551, Texas Government Code. <br /> <br />Section 9. Emergency. The City Council hereby finds the adoption of this Ordinance as an <br />emergency is necessary to protect the public interest and business, and that an emergency <br />condition exists which warrants a suspension of the general requirement that ordinances be read <br />at three meetings of the City Council.
