<br />Saturday, Sunday and holidays. <br /> <br />1.3.5 Will provide a telephone response to the City's call for service within 30 minutes. <br /> <br />1.3.6 Will enSure equipment manufacturer has resources to timely deliver replacement <br />parts as required to keep system in operation. <br /> <br />1.4 SHIPMENT AND DELIVERY <br /> <br />WHECO: <br /> <br />1.4.1 Will not ship goods under reservation and understands that tender of a bill of <br />lading does not operate as a tender of goods. <br /> <br />1.4.2 Will be responsible for the proper labeling, packing, and delivery to final <br />destination, including replacement of rejected deliveries at no additional cost to the City. <br /> <br />1.4.3 Assure that all goods required to be delivered under this contract are made Free <br />on Board (FOB) to the final destination at the address indicated on each purchase order <br />placed against this Contract. WHECO understands that title and risk of loss of the goods <br />will not pass to the City until receipt and acceptance takes place at the FOB point. <br /> <br />1.5 WARRANTY <br />WHECb: <br /> <br />1.5.1 Warrants that all equipment delivered conforms to the specifications and/or <br />warranties as stated in the Uniform Commercial Code and the specifications, drawings, <br />or other descriptions furnished or incorporated by reference. WHECO further warrants that <br />all equipment is of merchantable quality, good workmanship, free from defects, and fit for <br />all purposes as specified in the Request for Proposals and in this Contract. <br /> <br />1.5.2 Guarantees that warranties of all parts, equipment, and workmanship will be for <br />a period of one year from the date of the City's acceptance of the equipment. <br /> <br />1.5.3. Will assist City to obtain equal or interchangeable equipment as possible in the <br />unlikely event some of the equipment specified by City becomes no longer available during <br />the first five years after purchase by City. <br /> <br />1.6 TRAINING <br /> <br />WHECO will provide one day of training by factory trained personnel for two City <br />employees of the Water Production Division on the proper operation and maintenance of <br />each item included in this Contract. <br /> <br />3 <br />
