<br />ARTICLE 2 <br />THE CITY'S RESPONSIBILITIES <br /> <br />The City will: <br /> <br />2.1 Designate George Boeker, Director of Public Works, to act as the City's authorized <br />representative with respect to this Contract. <br /> <br />2.2 Provide underground excavation and process TAPS for monitoring device <br />connection. <br /> <br />2.3 Provide connection to telephone line terminal at each location and provide for <br />telephone service to each location in close proximity to equipment being installed. <br /> <br />2.4 Inspect and accept any and all deliveries made and reject items which in the City's <br />opinion are damaged, vary in quantity from what is specified in this Contract or which do <br />not conform to the contract specifications. <br /> <br />2.5 Bear all costs incident to this Article. <br /> <br />ARTICLE 3 <br />PAYMENTS TO WHECO <br /> <br />3.1 P~yments <br /> <br />Payments for services will be made to Contractor following receipt by the City of <br />WHECO's invoices. The first invoice will include 90% of fee due upon completion of the <br />Project. The balance of the fee will be due upon final acceptance of the Project by the <br />City. Final acceptance shall not exceed 60 days. The City The amounts of these invoices <br />will be in accordance with Article 10 of this Contract, less any disputed amounts, pending <br />resolution thereof. During the course of this Contract, WHECO will inform the City and give <br />the City the opportunity to take advantage of any price decrease on the items ordered <br />offered to similar customers. <br /> <br />ARTICLE 4 <br />WAGE RATE REQUIREMENTS <br /> <br />WHECO understands that it must comply with all current Federal and State of Texas <br />wage laws, including the Texas Prevailing Wage Rate Statute. This Contract will not be <br />funded in whole or part with federal funds, and the provisions of the Davis Bacon and <br />related acts will not apply. In accordance with State law, WHECO will: <br /> <br />4.1 Pay all laborers, workers and mechanics of all skills employed at the sites to perform <br />work for not less than the general prevailing rate of per diem wages for work of a similar <br /> <br />4 <br />
