ARTICLE 2 THE CITY'S RESPONSIBILITIES The City will: 2.1 Designate George Boeker, Director of Public Works, to act as the City's authorized representative with respect to this Contract. 2.2 Provide underground excavation and process TAPS for monitoring device connection. 2.3 Provide connection to telephone line terminal at each location and provide for telephone service to each location in close proximity to equipment being installed. 2.4 Inspect and accept any and all deliveries made and reject items which in the City's opinion are damaged, vary in quantity from what is specified in this Contract or which do not conform to the contract specifications. 2.5 Bear all costs incident to this Article. ARTICLE 3 PAYMENTS TO WHECO 3.1 P~yments Payments for services will be made to Contractor following receipt by the City of WHECO's invoices. The first invoice will include 90% of fee due upon completion of the Project. The balance of the fee will be due upon final acceptance of the Project by the City. Final acceptance shall not exceed 60 days. The City The amounts of these invoices will be in accordance with Article 10 of this Contract, less any disputed amounts, pending resolution thereof. During the course of this Contract, WHECO will inform the City and give the City the opportunity to take advantage of any price decrease on the items ordered offered to similar customers. ARTICLE 4 WAGE RATE REQUIREMENTS WHECO understands that it must comply with all current Federal and State of Texas wage laws, including the Texas Prevailing Wage Rate Statute. This Contract will not be funded in whole or part with federal funds, and the provisions of the Davis Bacon and related acts will not apply. In accordance with State law, WHECO will: 4.1 Pay all laborers, workers and mechanics of all skills employed at the sites to perform work for not less than the general prevailing rate of per diem wages for work of a similar 4
