<br />commencement of operations and are subject to Lessor's approval. Insurance carriers <br />insuring Lessee in accordance herewith which are rated by the recent edition of Best's Key <br />Ratina Guide, Property-Casualty. published by A.M. Best Company, or insurance carriers <br />having a rating lower than B+VlI as shown in the most recent edition of said book, will not <br />be approved by Lessor unless a guaranty bond acceptable to Lessor from a carrier rated <br />B+VII or higher guaranteeing payment of any and all claims against Lessee is furnished to <br />Lessor. <br /> <br />All insurance required under this section shall be written with Lessor as an additional <br />insured. The stated limits of insurance required by this section are MINIMUM ONLY and it <br />shall be Lessee's responsibility to determine what limits are adequate. These minimum limits <br />may be basic policy limits or any combination of basic limits and umbrella limits. In any <br />event, Lessee is fully responsible for all losses arising out, resulting from or connected with <br />operations under this Lease whether or not said losses are covered by insurance. Lessor's <br />acceptance of Certificates of Insurance that in any respect do not comply with the lease <br />requirements does not release Lessee from compliance herewith. <br /> <br />All insurance required under this section shall be primary over any other insurance <br />coverage Lessor may have. <br /> <br />5.2 Indemnity: <br /> <br />A. Lessee shall indemnify Lessor and save it harmless from suits, actions, damages. <br />liability and expense in connection with the loss of life, bodily or personal injury or property <br />damage arising from or out of any occurrence in or upon the Leased Premises or from the <br />occupancy or the use by Lessee of said premises or any part thereof, or occasioned wholly <br />or in part by any act or omission of Lessee, its agents, contractors, employees, servants, <br />invitees, licensees or concessionaires, in their use of the Leased Premises, the runways and <br />taxiways and any other area within the Airport; and, <br /> <br />8. Lessee shall store its property in, and shall occupy the Leased Premises and all other <br />portions of the Airport at its own risk, and releases Lessor, to the full extent permitted by law, <br />from all claims of every kind resulting in loss of life, personal or bodily injury or property <br />damage; and <br /> <br />C. Lessor shall not be responsible or liable at any time for any loss or damage of <br />Lessee's fixtures, machinery, airplane(s) or other personal property of Lessee; and <br /> <br />D. Lessor shall not be responsible or liable to Lessee or to those claiming by, through, <br />or under Lessee for any loss or damage to either the person or property of Lessee that may <br />be occasioned by or through the acts or omissions of persons occupying adjacent, <br />connecting, or adjoining premises; and <br /> <br />E. Lessor shall not be responsible for liable for any defect, latent or otherwise, in any <br />building in the airport area or of any of the equipment, machinery, utilities, appliances or <br />apparatus therein or thereupon, not shall it be responsible or liable for any injury, loss or <br />damage to any person or to any property of Lessee or any other person caused by or <br />resulting from any bursting, breakage of or from leakage from pipes; steam or snow or ice, <br />running, backing up, or overflow of water or sewage in any part of the Leased Premises, or <br />from any injury or damage caused by or resulting from any defects or negligence in the <br /> <br />4 <br />
