<br />1.7. 5 Be responsible for the printing and binding of 20 sets of bid documents at no additional I <br />cost to the City. In addition, the Engineer will provide one electronic file in .PDF format and all <br />native electronic files of plans and bid documents to the City's Purchasing Division for <br />distribution. <br /> <br />1.7.6 Ensure that no reports, maps, or other documents produced in whole or in part under this <br />Agreement will be the subject of an application for copyright by or on behalf of the Engineer. <br /> <br />1.7.7 Obtain approval from the City all technical plans and specifications necessary for <br />successful completion of the Project prior to allowing the construction contract to be let for bid. <br /> <br />1.7.8 Assist the City in the distribution of the bid documents to prospective bidders and to plan <br />rooms and the preparation and issuance of addenda (if any) following City's prior approval. <br /> <br />1.7.9 Assist the City in obtaining bids, tabulating bids, preparing bid tabulation forms, and in <br />awarding the contract for construction following the City's approval of the construction contract <br />documents and of the latest detailed final cost estimate of the Project. <br /> <br />1.7.10 Assist the City in reviewing the Statement of Bidder's Qualifications, financial statements <br />of bidders, lists of bidders' proposed subcontractors, and all other documents required to be <br />submitted with the bids. <br /> <br />1.7.11 Make a written recommendation to the City regarding award of bid; and assist the City in I <br />conducting a pre-bid conference and answer all questions of prospective or potential bidders and <br />City's staff and make all necessary clarifications and interpretations of the construction contract <br />documents. <br /> <br />1.7.12 Have no authority to issue a Notice to Proceed to any Contractor. <br /> <br />Construction Administration <br /> <br />1.7.13 Provide administration of the construction contract as set forth in the construction <br />documents unless otherwise provided in this Agreement and incorporated in the construction <br />contract documents. The Engineer is responsible for overseeing all construction operations, <br />including ensuring that all environmental permits, issues, coordination, mitigation, and <br />commitments are adequately addressed, of assessing potential environmental effects of contract <br />revisions, and of obtaining environmental permits, issues coordination, mitigation, and <br />commitments that may be required by contract revisions. The Engineer will ensure that all <br />contract revisions comply with the latest version of all Federal and State administrative criteria <br />and manuals. The Engineer will not authorize any contract revision without the prior written <br />approval of TxDOT if it will affect prior environmental approvals, significantly revise the scope <br />of the Project or the geometric design, or change the cost to TxDOT. The Engineer will adhere <br />to the TxDOT procedures governing. The Engineer will not pursue a course of conduct which I <br />might jeopardize any of the City's rights hereunder.
