<br />I <br /> <br />I <br /> <br />I <br /> <br />1.6.1 Include all permit activities following field work until the issuance of the permit in this <br />Project element. In addition, the Engineer will prepare Section 404 permits if authorized under <br />Nationwide Permit 14 and the Project requires a preconstruction notification (PCN). The <br />Engineer will prepare TCEQ plans for EAPP Water Pollution Abatement plans. <br /> <br />1.6.2 Ensure permitting process is on schedule for construction and any issues are transmitted <br />to the City and follow-up with agencies to ensure permits are successfully processed through the <br />system. <br /> <br />1.6.3 Complete permitting during the design phase of the Project, including coordinating with <br />the City and other agencies. <br /> <br />1.7 TASK 6 - BIDDING AND CONSTRUCTION ADMINISTRATION <br /> <br />The Construction phase of this Project will commence with the award of the construction <br />contract and will terminate when the Project is accepted by the City. The Engineer will <br />administer the bidding and construction phase of the Project in accordance with the City's Pass- <br />Through Toll Agreement and Local Transportation Project Advance Funding Agreement with <br />TxDOT. The Engineer will not pursue a course of conduct that could jeopardize any of the <br />City's rights or benefits under those agreements with TxDOT. The Engineer will: <br /> <br />Biddin~ <br /> <br />1.7.1 Assist the City in the preparation of construction contract documents using City forms <br />based on the approved design development documents and any further adjustments authorized by <br />the City in the scope, quality or budget of the Project. These contract documents will include <br />detailed plans and technical specifications required for the Project to be accurately bid and <br />efficiently constructed. <br /> <br />1.7.2 Prepare and provide the bid document in digital format to the City. <br /> <br />1.7.3 Use its best professional judgment to create technical documents that comply with <br />applicable construction and development codes, local regulations and ordinances and other <br />federal and state regulations which are known or which should reasonably be known to the <br />Engineer including those required under the ADA and Article 9102, V.A.C.S., Architectural <br />Barriers Act. The Engineer will be responsible for the submission of all plans and specifications <br />for the construction of this Project to the Texas Department of Licensing and Regulation for <br />review and approval prior to the time construction is set to begin in conformance with the <br />Architectural Barriers Act. The costs associated with the submission of plans for review under <br />the Architectural Barriers Act will be paid by the City. <br /> <br />1.7.4 Prior to letting the Project for bid, the Engineer will obtain authorization from TxDOT <br />and the FHW A and will include the latest version of Form FHW A-1273 in the bid documents. <br />In the event the City utilizes force account work, a finding of cost effectiveness will be made by <br />the Engineer in compliance with 23 CFR 635, Part B. <br /> <br />15 <br />
