<br />1.8 ADDITIONAL SERVICES/CHANGE IN SERVICES <br /> <br />1.8.1 Since the Engineer's compensation is a fixed fee for Basic Services, including minor <br />deviations from those described in this Agreement, compensation to the Consultant for additional <br />services will only be for substantial deviations from the scope of services described in this <br />Agreement. The Consultant will submit a written estimate of fees to the City and obtain the <br />City=s authorization before initiating any additional services. In the event that any of the <br />following assumptions change, and the Engineer's services are required in association with the <br />following items, such work will be considered an additional service(s) and will be subject to the <br />provisions of this Subsection: <br />(a) Re-evaluation of the EA is not anticipated but could be necessary if the design <br />changes significantly, an endangered species becomes listed that could be affected <br />by the Project, or some other unforeseen circumstance arises that meet the criteria <br />for are-evaluation. <br />(b) If vegetation clearing in and adjacent to mapped GCW habitat cannot be avoided <br />during the nest season (from March 1 to August 1) a survey for GCW nests would <br />be required. This is not anticipated. Any conservation measures if GCW issues <br />arise are also not anticipated. <br />(c) No surveys for migratory birds are anticipated because the clearing of vegetation <br />would likely be conducted outside of the normal nesting season for most birds <br />(March through August). If land clearing is necessary during the nesting season, <br />a nest survey must be conducted first, however this is not anticipated. <br />(d) Additional presence/absence survey for federally listed threatened or endangered <br />species is not anticipated. <br />(e) Additional Section 7 consultations under the Endangered Species Act are not <br />included in this Agreement. <br />(f) Activities associated with an Individual Section 404 (Clean Water Act) permit or <br />detailed mitigation planning are not included in this Agreement. <br />(g) Surveys and environmental review of Contractor and Construction Specific <br />Activities such as borrow pits, batch plants, etc are not included in this <br />Agreement. Environmental clearances, including permits, will be obtained by the <br />construction contractor. <br /> <br />1.8.2 Each material change (deletion or addition) in the services to be provided by Engineer <br />must be authorized by the City on the Authorization of Change in Services form attached to this <br />Agreement as Attachment C. Compensation for additional services will be in addition to that <br />specified for Basic Services in accordance with Section 15.2 of this Agreement.
