i44. <br />Regular Meeting March 24, 2003 Page 8 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AWARDING A CONSTRUCTION CONTRACT TO NELSON LEWIS, INC. FOR THE <br />TANGLEWOOD LIFT STATION REMOVAL PROJECT; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THE CONTRACT DOCUMENTS ON BEHALF OF THE CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AWARDING AN ANNUAL CONTRACT TO COLORADO MATERIALS FOR THE PURCHASE OF <br />ROAD BUILDING MATERIAL FOR THE STREET DEPARTMENT; AUTHORIZING THE <br />PURCHASING MANAGER TO EXECUTE PURCHASING DOCUMENTS ON BEHALF OF THE <br />CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither introduced for consideration Item 19 removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AMENDMENT NO. 2 TO A SUBRECIPIENT AGREEMENT BETWEEN THE <br />CITY AND THE MITCHELL CENTER, AUTHORIZING THE CITY MANAGER TO EXECUTE <br />THIS AMENDMENT ON BEHALF OF THE CITY; AND DELARING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution, and Ms. Narvaiz <br />seconded the motion. Mr. O'Leary stated the Mitchell Center is requesting <br />an extension to extend the subrecipient agreement for 2 to 3 years to <br />enable them to secure additional funding. Mayor Habingreither stated he <br />is in favor of extending the agreement for one year to allow the Council <br />the opportunity to review the matter. Mr. Mihalkanin stated he is okay <br />with a one-year extension if wording is explicit to not continue extending <br />the agreement. Ms. Narvaiz stated she feels a one-year extension may be <br />too short a time frame. She encouraged the Council to extend the <br />agreement for two years and request a progress report in one year. Mr. <br />Mayhew stated he agrees a one-year extension may be difficult to build a <br />building. Mayor Habingreither stated he would support a two-year <br />extension with a provision of a report required in one year. Mr. Mayhew <br />inquired to the status of the building process. Kyev Tatum, Founder and <br />President of the Mitchell Center, stated they have had trouble identifying <br />financing because they do not own land. He stated they have also asked <br />the County for a down payment. They have asked the school for use of an <br />old building. He stated they need help from the City and CDBG funds. <br />Mayor Habingreither stated he feels something should be available in grant <br />funds. Mr. Tatum stated the Mitchell Center needs support from the City, <br />County and community. Mr. Mayhew stated he supports the agreement <br />extension for two years and a status report in one year. Mr. Mihalkanin <br />moved to amend 1. of Section 9.1 to read...Section 9.1 is amended to <br />increase the amount of time within which the Subrecipient will complete <br /> <br />the work from two years from the date of execution of the Agreement to two <br />years from the date of the City's execution of this Amendment and to add <br /> <br />the following to the end of the text of Section 9.1 and The Subrecipient <br />shall submit a written report to the City on the progress of the <br /> <br /> <br />
