<br />INTERLOCAL AGREEMENT BETWEEN <br />THE CITY OF SAN MARCOS, HAYS COUNTY, AND <br />THE CITY OF KYLE FOR THE PROVISION OF ANIMAL SHELTER SERVICES <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />The City of San Marcos ("San Marcos"), the City of Kyle ("Kyle") and Hays County (the <br />"County"), enter into this Interlocal Agreement under the authority of the Interlocal Cooperation <br />Act (the "Act"), Chapter 791 of the Texas Government Code, as amended. The County, Kyle, <br />and San Marcos wish to enter into an agreement for San Marcos' provision of animal shelter <br />services through the San Marcos Animal Shelter (the "Shelter"). <br /> <br />San Marcos, Kyle, and the County understand that San Marcos' Animal Services <br />Division currently operates and maintains a centralized animal shelter that is charged with <br />responding to calls for service regarding animals and protecting public property from animal- <br />related damage. The Shelter is open six days per week to the general public and is staffed 365 <br />days a year. <br /> <br />The Parties anticipate that this cooperative partnership will accomplish the following <br />goals beneficial to all residents in Kyle and Hays County: <br /> <br />Proper care and responses to animals; <br />Mutual concern for controlling expenses related to animal shelter services; and <br />· Utilization of return to owner and adoption of animals prior to humane methods of <br />euthanasia. <br /> <br />Section 1. Scope of Services <br /> <br />A. San Marcos Aereements: <br /> <br />San Marcos agrees to: <br /> <br />1. Designate the Animal Services Manager for the City of San Marcos, as San Marcos' <br />representative in all matters related to this Agreement. <br />2. Receive and shelter animals delivered from the County immediately upon the <br />execution of this Agreement. The Parties anticipate that the Shelter will receive 2,400 <br />additional dogs and cats from the County on an annual basis, and costs to the County <br />under this Agreement are based on this estimate. Animals received by the Shelter <br />from the County in excess of 2400 per year will be accepted on a per animal cost <br />basis. The Shelter does not accommodate livestock. <br />3. Receive and shelter animals delivered from Kyle immediately upon the execution of <br />this Agreement. The Parties anticipate that the Shelter will receive 1,450 additional <br />dogs and cats from Kyle on an annual basis, and costs to Kyle under this Agreement <br />are based on this estimate.
