<br />STATE OF TEXAS <br /> <br />~ DEVELOPMENT AGREEMENT WITH <br />~ <br />~HARRIS HILL ROAD, INC. FOR <br />~ <br />~ A SPORTS VEHICLE TRACK AND FACILITY <br /> <br />COUNTY OF HAYS <br /> <br />CITY OF SAN MARCOS <br /> <br />This Development Agreement (the "Agreement") is entered into this 20th day of <br />September ,2006, by and between the City of San Marcos, a Texas Home Rule <br />Municipal Corporation ("City") and Harris Hill Road, Inc., a Texas corporation ("Harris)". <br /> <br />WHEREAS, Harris is the owner of that certain 150 (+/-) acre tract of land (the "Property") <br />located on Harris Hill Road, and more specifically described on Exhibit "A", which is attached <br />hereto and incorporated herein for all purposes as if set forth in full; <br /> <br />WHEREAS, Harris has proposed to construct or cause to be constructed on the Property a sports <br />vehicle track and ancillary facilities; <br /> <br />WHEREAS, the Property is located within the extra-territorial jurisdiction of the City, and this <br />Agreement is subject to Chapter 212, Subchapter G, of the Texas Local Government Code, and <br />Chapter 2, Article 2 of the City's Land Development Code; <br /> <br />WHEREAS, the development of the Project in accordance with this Agreement will assist the <br />City in implementing the policies of the City's Master Plan and the criteria of Chapter 2 of the <br />City's Land Development Code; and <br /> <br />WHEREAS, the City and Harris wish to enter into this Agreement to promote economic <br />development, the orderly development of the Project and the future annexation of the Property. <br /> <br />1. Description of Project <br /> <br />1.1 Land Use Plan. The project shall consist of an approximately 1.8 mile long x 36 <br />foot wide sports vehicle track, together with the ancillary buildings, improvements and facilities <br />depicted on the Land Use Plan attached as Exhibit "B" (collectively, the "Project"). <br /> <br />1.2 Ancillary Facilities. The ancillary facilities constructed on the Property may <br />include buildings comprising up to 20,000 square feet of enclosed space, up to fifty (50) covered <br />parking spaces and the other parking, paved areas, pits, driveways, berms and improvements as <br />depicted on Exhibit "B". <br /> <br />1.3 Impervious Cover. The total impervious cover of the Project shall not exceed the <br />amount of impervious cover depicted on the Land Use Plan attached as Exhibit "B", <br /> <br />1.4 Land Uses. The land uses authorized on the Property shall be (a) the operation, <br />use, maintenance and repair of the Project in accordance with the Development and Operating <br /> <br />Execution Version: 082306 <br />
