<br />Standards set forth in Exhibit "C", (b) uses directly relating or ancillary to the operation of a <br />sports vehicle track and the facilities depicted on Exhibit "B", such as maintenance, storage or <br />display of vehicles, and the operation, use, maintenance and repair of a skid pad, berms and the <br />other facilities depicted on Exhibit "B", but subject in all respects to the Agreed Operating <br />Standards set forth in Exhibit "C", (c) meetings and assemblies of sports vehicles operators and <br />their vehicles and guests in accordance with the Agreed Operating Standards set forth in Exhibit <br />"C", and (d) the operation of classes or a school for safety and driving instruction, including <br />classrooms, drivers education programs and specialized instruction for groups such as teenagers, <br />sports vehicle drivers or police/fire/EMS, The foregoing authorized uses are referred to in this <br />Agreement as the "Authorized Land Uses." Harris agrees to restrict uses on the Property to the <br />Authorized Land Uses, and to allow no other uses of the Property. <br /> <br />1.5 Expansion. Any expansion or modification of the Project or the Authorized Land <br />Uses requires an amendment to this Agreement. <br /> <br />1.6 Use of Portions of Property Subiect to Future Roadway Dedication. No portion of <br />the sports vehicle track and no buildings or berms may be constructed on the portion of the <br />Property subject to future dedication for roadway use under Paragraph 8 below, <br /> <br />2. Proposed Schedule of Development <br /> <br />2,1 Commencement of Construction of Proiect. Harris shall commence construction <br />of the Project, subject to force majeure, within three (3) months from the date of the last permit <br />approval by the City authorizing construction pursuant to this Agreement. Harris will provide <br />written notice to the City of the date of commencement of construction. <br /> <br />2.2 Completion of Construction. Harris shall complete construction of the Project, <br />subject to force majeure, within eighteen (18) months from the date of commencement of <br />construction. Harris will be deemed to have completed construction when the sports car track is <br />open for use. Harris will provide written notice to the City of the date of completion of <br />construction. <br /> <br />2.3 Extension, Any of the deadlines specified above may be extended for up to <br />twelve (12) months upon approval of the City Planning Director. Any greater extension requires <br />an amendment to this Agreement. <br /> <br />3. Proposed Base Zoning Districts following Annexation. The base zoning district for <br />the Property upon annexation shall be "FD" Future Development District, provided that the <br />operation of the Project and the Authorized Land Uses shall continue to be permitted as lawful <br />uses following annexation, for so long as the Project is developed and operated in accordance <br />with this Agreement. <br /> <br />4. Applicable and Excluded Development Standards <br /> <br />4.1 Applicable Development Standards, The Development Standards of the City's <br />Land Development Code shall apply to the Project, to the extent they are applicable to the <br /> <br />2 <br /> <br />Execution Version: 082306 <br />
