<br />Project because of its characteristics as depicted on Exhibit "B", and except as expressly <br />modified by the development standards in Exhibit "C". <br /> <br />5. Development Applications. Upon approval, execution and recording of this Agreement, <br />Harris will be required to apply for and obtain a Watershed Protection Plan in accordance with <br />Chapter I, Article 7 of the City's Land Development Code and a Site Preparation Permit in <br />accordance with Chapter 1, Article 8 of the City's Land Development Code before commencing <br />construction of the Project. No other development applications will be required in connection <br />with the Project unless Harris modifies or expands the Project. <br /> <br />6. Agreed Operating Standards. The Operating Standards listed in Exhibit "c" shall <br />apply to the operation of the Project. <br /> <br />7. Utility Services, The City will not be required to provide utility services to the Project. <br />Wastewater will be provided by on-site septic facilities and water will be provided by Maxwell <br />Water Supply Corporation. <br /> <br />8. Financing of Public Services. During the term of this Agreement, upon written request <br />of the City, Harris agrees to dedicate (a) a strip of land parallel to the right of way of Harris Hill <br />Road in size sufficient to expand the right of way to the east of the current center line of Harris <br />Hill Road to forty two and one half feet (42.5'), as generally depicted on Exhibit "B" and <br />designated as "Land Subject to Dedication for Future Expansion of Harris Hill Road", it being <br />understood that the precise location of the current centerline of such roadway has not been <br />surveyed and upon the City's completion of such survey of the current centerline and delivery of <br />the survey to Harris, the parties shall work in good faith to determine the precise location of land <br />to be dedicated by Harris pursuant to this clause, (b) approximately 3.06 acres along the east <br />border of the Property for the construction of Loop 110, as depicted on Exhibit "B" and <br />designated as "Land Subject to Dedication for Loop 110 Construction" and (c) a strip of land <br />forty two and one half feet (42.5') wide parallel to the northern border of the Property for the <br />future right of way of William Pettus Road, as generally depicted on Exhibit "B" and designated <br />as "Land Subject to Dedication for Future William Pettus Road Right of Way". The dedication <br />shall be by special warranty deed in the form customarily requested by the City, except as Harris <br />and the City may reasonably agree, provided that Harris shall have no obligation to pay any out <br />of pocket expenses in connection with the preparation and recording of the instrument. Because <br />of the limited nature of the development involved in the Project, no other dedication, <br />construction of public improvements or payment of fees by Harris is required by the City in <br />connection with the development of the Project. <br /> <br />9. Annexation. <br /> <br />9.1 Annexation of Land Located within Fifteen Feet (15') of Property Perimeter. The <br />City may annex all or a portion of the land located within fifteen feet (15') of the perimeter of <br />the Property and designated on Exhibit "B" as "Land Subject to Annexation Upon Request by <br />City" at any time during the term of this Agreement. Harris hereby voluntarily consents to <br />annexation of all or any portion of the land located within fifteen feet (15') of the perimeter of <br />the Property and designated on Exhibit "B" as "Land Subject to Annexation Upon Request by <br /> <br />3 <br /> <br />Execution Version: 082306 <br />
