<br />I <br /> <br />I <br /> <br />I <br /> <br />RESOLUTION NO. 2006-132 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS PROPOSING THE DESIGNATION <br />OF THE SAN MARCOS CONFERENCE CENTER AS A <br />VENUE PROJECT UNDER CHAPTER 334 OF THE TEXAS <br />LOCAL GOVERNMENT CODE; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City is in the process of developing the San Marcos Conference Center Project (the <br />"Conference Center Project") at the intersection ofIH-35 South and McCarty Lane in partnership <br />with JQH - San Marcos Development, LLC ("JQH"), which is developing an Embassy Suites hotel <br />in conjunction with the Conference Center Project. <br /> <br />2. Texas Local Government Code Chapter 334 provides financing mechanisms for a city to <br />use in developing a "venue project," which may consist of a "convention center facility or related <br />improvement" . <br /> <br />3. Texas Local Government Code 9334.021 provides for the City by resolution to "provide <br />for the planning, acquisition, establishment, development, construction, or renovation of a venue <br />project" if the State Comptroller determines "that the implementation of the resolution will not have <br />a significant negative fiscal impact on state revenue". <br /> <br />4. Texas Local Government Code 9 334.021 requires the resolution to "designate each venue <br />project and each method of financing authorized by this chapter that the [City] wants to use to <br />finance a proj ect". <br /> <br />5. Texas Local Government Code 9 334.021 also requires the designation ofa venue project <br />to be approved by "a majority of the qualified voters of the City voting at an election called and held <br />for that purpose". <br /> <br />6. The City Council wishes to propose the designation of the Conference Center Project as a <br />venue project under Texas Local Government Code Chapter 334, with the project being financed in <br />part by an additional hotel occupancy tax of up to 2% under Texas Local Government Code <br />99334.252 through 252.254, subject to approval by the qualified voters of the City at an election to <br />be held on November 7,2006. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The City Council proposes the designation of the Conference Center Project as a <br />venue project under Texas Local Government Code Chapter 334, with financing in part by an <br />additional hotel occupancy tax of up to two percent (2%) under Texas Local Government Code <br />
