<br />115 <br /> <br />INTERLOCAL AGREEMENT <br />CITY OF SAN MARCOS AND GUADALUPE-BLANCO RIVER AUTHORITY <br />CONSTRUCTION MANAGEMENT SERVICES FOR <br />THE SURFACE WATER TREATMENT PLANT EXPANSION PROJECT <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />The City of San Marcos ("City") and the Guadalupe-Blanco River Authority ("GBRA"), <br />enter into this Interlocal Agreement under the authority of the Interlocal Cooperation Act, <br />Chapter 791 of the Texas Government Code, as amended. <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the GBRA is a conservation and reclamation district and political <br />subdivision of the State of Texas, created pursuant to Article XVI, Section 59 of the Texas <br />Constitution, by special act of the Legislature; and <br /> <br />WHEREAS, the City is a municipality organized under the laws of the State of Texas; <br /> <br />and <br /> <br />WHEREAS, the City has entered into a construction project ("City Project") for the <br />expansion of the City Surface Water Treatment Plant (the "Plant") which will include the <br />expansion of the capacity of the Plant from 9 million gallons per day (mgd) to 21 mgd.; and <br /> <br />WHEREAS, GBRA is currently under contract with the City for the operation and <br />management of the Plant; and <br /> <br />WHEREAS, the City and GBRA agree that it is in the best interest of the parties to <br />engage GBRA for the provision of construction management services related to the City Project <br />due to GBRA's continual operation of the Plant and familiarity with the City Project site; and <br /> <br />WHEREAS, pursuant to the authority granted to the City and GBRA under applicable <br />law, including Section 791.011 of the Government Code, in furtherance of the above-referenced <br />purpose, the City and GBRA wish to enter into this Agreement. <br /> <br />NOW THEREFORE, the City and the GBRA, for and in conslderation of the covenants <br />and agreements set forth herein, agree as follows: <br /> <br />Section 1. Purpose of Al!reement <br /> <br />The purpose of this Agreement is for the provision of construction management services in <br />connection with the City Project. GBRA and the City agree that this agreement serves a public <br />purpose in that it will provide quality assurance and quality control for the City Project and <br />coordination of the City Project with ongoing operation of the Plant by GBRA. <br /> <br />GBRA Interlocal 2006 <br /> <br />1 <br />
