Interlocal Agreement City of San Marcos and Texas State University-San Marcos Modifications to Sessom Drive, Tomas Rivera Drive, Student Center Drive, and Comanche Street The City of San Marcos ("City") and Texas State University-San Marcos ("Texas State"), enter into this Interlocal Agreement under the authority of the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended. Section 1. Purpose of Aareement The purpose of this Agreement is to assist Texas State with implementing the part of its Campus Master Plan that affects public streets and traffic flow in the vicinity of Sessom Drive, Tomas Rivera Drive, and Comanche Street (the "Project Area"), and to do so in a manner that maximizes safety and efficiency in traffic flow within and through the Project area. Section 2. Texas State Aareements Texas State agrees to: 1. Reconstruct, at Texas State's expense, the intersection of Tomas Rivera Drive and Sessom Drive as depicted on the diagram attached to this Agreement as Exhibit A. The new intersection shall be constructed as an intersection restricted to right entrance, right exit, to and from Sessom Drive with the appropriate acceleration and deceleration lanes, as depicted on the attached Exhibit A. 2. Reconstruct, at Texas State's expense, Student Center Drive so that it intersects with Comanche Street as depicted on the attached Exhibit A. 3. Install, at Texas State's expense, a new traffic signal at the intersection of Comanche Street and Student Center Drive The signal will be installed in a manner such that the signal is compatible with the City's traffic signalization system; and convey the installed signal to the City by Bill of Sale when the installation is complete and accepted by the City. 4. Convey to the City a strip of land sufficient in width to make a 60 foot total Right of Way width along Comanche Street from Student Center Drive to Sessom Drive, to be used for a future fifth lane on Comanche Street. The strip of land is to be located on the east side of Comanche Street, as depicted on the attached Exhibit A. 5. Work with the City to identify an alternate bike route through the Texas State Campus to replace the Comanche Street bike lanes.
