<br />Interlocal Agreement <br />City of San Marcos and Texas State University-San Marcos <br />Modifications to Sessom Drive, Tomas Rivera Drive, Student Center Drive, and <br />Comanche Street <br /> <br />The City of San Marcos ("City") and Texas State University-San Marcos ("Texas <br />State"), enter into this Interlocal Agreement under the authority of the Interlocal <br />Cooperation Act, Chapter 791 of the Texas Government Code, as amended. <br /> <br />Section 1. Purpose of Aareement <br /> <br />The purpose of this Agreement is to assist Texas State with implementing the <br />part of its Campus Master Plan that affects public streets and traffic flow in the vicinity of <br />Sessom Drive, Tomas Rivera Drive, and Comanche Street (the "Project Area"), and to <br />do so in a manner that maximizes safety and efficiency in traffic flow within and through <br />the Project area. <br /> <br />Section 2. Texas State Aareements <br /> <br />Texas State agrees to: <br /> <br />1. Reconstruct, at Texas State's expense, the intersection of Tomas <br />Rivera Drive and Sessom Drive as depicted on the diagram attached to this <br />Agreement as Exhibit A. The new intersection shall be constructed as an <br />intersection restricted to right entrance, right exit, to and from Sessom Drive with <br />the appropriate acceleration and deceleration lanes, as depicted on the attached <br />Exhibit A. <br /> <br />2. Reconstruct, at Texas State's expense, Student Center Drive so that it <br />intersects with Comanche Street as depicted on the attached Exhibit A. <br /> <br />3. Install, at Texas State's expense, a new traffic signal at the intersection <br />of Comanche Street and Student Center Drive The signal will be installed in a <br />manner such that the signal is compatible with the City's traffic signalization <br />system; and convey the installed signal to the City by Bill of Sale when the <br />installation is complete and accepted by the City. <br /> <br />4. Convey to the City a strip of land sufficient in width to make a 60 foot <br />total Right of Way width along Comanche Street from Student Center Drive to <br />Sessom Drive, to be used for a future fifth lane on Comanche Street. The strip of <br />land is to be located on the east side of Comanche Street, as depicted on the <br />attached Exhibit A. <br /> <br />5. Work with the City to identify an alternate bike route through the Texas <br />State Campus to replace the Comanche Street bike lanes. <br />
