<br />Section 3. City of San Marcos Aareements <br /> <br />The City agrees to: <br /> <br />1. Accept the changes to the Tomas Rivera Drive and Sessom Drive <br />intersection. <br /> <br />2. Approve the installation of a traffic signal at the reconstructed <br />intersection of Student Center Drive and Comanche Street. <br /> <br />3. Move, at the City's expense, the traffic signal that currently exists at the <br />intersection of Tomas Rivera Drive and Sessom Drive and install the signal at the <br />intersection of Comanche Street and Sessom Drive. <br /> <br />4. Re-stripe the pavement, at the City's expense, Comanche Street from <br />Student Center Drive to Sessom Drive into a four lane road, eliminating the <br />current bike lanes. <br /> <br />5. Work with Texas State to identify an alternate bike route through the <br />Texas State Campus to replace the Comanche Street bike lanes. <br /> <br />Section 4. Term <br /> <br />The term of this Agreement will commence on the date of acceptance by both <br />Parties and will continue until all of the work is completed and accepted by the Parties. <br /> <br />Section 5. Miscellaneous Provisions <br /> <br />a) Interlocal Cooperation: The City and Texas State agree to cooperate with <br />each other in good faith at all times during the term of this Agreement in order to <br />achieve the purpose of this Agreement. Each party to this Agreement acknowledges <br />and represents that this Agreement has been executed by its duly authorized <br />representative. <br /> <br />b) Entire Aqreement: This Agreement contains the entire agreement <br />between the parties and supersedes all prior understandings and agreements between <br />the parties regarding such matters. This agreement may not be modified or amended <br />except by written agreement executed by both parties. Neither party may assign this <br />Agreement without the written consent of the other party. <br /> <br />c) Interpretation: The parties acknowledge and confirm that this <br />Agreement has been entered into pursuant to the authority granted under the Act. All <br />terms and conditions are to be construed and interpreted consistently with the Act. <br /> <br />d) Invalid Provision: Should any provision in this Agreement be found or <br />deemed to be invalid, this Agreement will be construed as not containing the provision, <br />
