<br />Regular Meeting <br /> <br />November 21, 2006 <br /> <br />Page 10 <br /> <br />Mr. Guerrero moved for adoption of the Resolution, and Mr. Thomaides <br />seconded the motion. Mr. O'Leary stated the purposes Hays Caldwell Public I <br />Utility Agency is to explore regional solutions for future water needs. He <br />stated the City Council previously approved the City's participation in <br />the formation of the Hays Caldwell Public Utility Agency, but the City of <br />Lockhart withdrew its participation. He stated that with the changes in <br />participating parties there is a need to re-create the PUA. Mr. Guerrero <br />inquired to why the City of Lockhart withdrew. Tom Taggart, Director of <br />Water/Wastewater, stated the City of Lockhart felt they had better choices <br />elsewhere. Mr. Bose inquired as to the location of the CRWA plant. Mr. <br />Taggart stated the CRWA plant is located South of HWY 80 on San Marcos <br />River. The Council then voted unanimously for adoption of Resolution. <br /> <br />Mayor Narvaiz introduced for consideration Item 26, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AWARDING A CONSTRUCTION CONTRACT TO MANLEY CONTRACTING FOR THE HOPKINS <br />STREET SIDEWALK PROJECT -PHASE I; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE CONTRACT DOCUMENTS ON BEHALF OF THE CITY AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Guerrero moved for adoption of the Resolution, and Mr. Thomaides I <br />seconded the motion. Mr. O'Leary stated that on September 28, 2006, five <br />bids were received for the Hopkins Street Sidewalks - Phase I Project. <br />Halff and Associates, the project consultant, reviewed all bids and <br />recommended awarding a contract to the low bidder, Manley Contracting in <br />the amount of $175,496.24. He stated this project is to construct an <br />eight foot wide bike/pedestrian sidewalks from the Parks and Activity <br />Center to the existing trails system along the North Side of Hopkins <br />Street. The Council then voted unanimously for adoption of the Resolution. <br /> <br />Mayor Narvaiz introduced a public hearing and consideration of adoption of <br />a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM MEDIUM DENSITY <br />RESIDENTIAL TO MIXED USE FOR A 1.339 ACRE, MORE OR LESS, TRACT OF LAND <br />LOCATED AT 324 LINDA DRIVEj AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY BY REZONING THIS TRACT FROM "MH" MANUFACTURED HOME DISTRICT TO <br />"MU" MIXED USE DISTRICTj INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to I <br />speak. Daniel Varges stated he is the owner of this property. He stated <br />the City changed the zoning and he is requesting that the City change the <br />zoning back to Mixed Use. Mayor Narvaiz asked if anyone else wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. <br />
