I I I RESOLUTION 2006 - ? 1 7 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING A LICENSE AGREEMENT BETWEEN THE CITY AND TEXAS STATE UNIVERISTY FOR THE USE OF SIDEWALKS ALONG GUADALUPE STREET AND NORTH LBJ DRIVE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE LICENSE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. Texas State University is the owner of property that is bounded on two sides by Guadalupe Street and North LBJ Drive. Texas State University is constructing a new building on this property and in conjunction with this construction will move and rebuild the sidewalks and adjoining area. 2. Texas State University has requested that upon final negotiation of the construction details the City Council approve the attached License Agreement in order for the University to have access to this property. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The City Council approves the attached License Agreement, in substantially the form attached to this Resolution. PART 2. The City Manager, Dan O'Leary, and the Interim City Attorney, Andy Quittner, and the City Engineer, Laurie Anderson, are authorized and directed to negotiate changes to and finalize the License Agreement and related documents in the manner they deem necessary and appropriate; and the City Manager, Dan O'Leary, is authorized to execute the final agreement and related documents, as changed and finalized, on behalf of the City. The City Manager's execution of the agreement shall be deemed to be conclusive evidence that the intent of this resolution is met and that the execution of the agreement was duly authorized by the City Council. PART 3. That this Resolution shall be in full force and effect from and after its passage. ADOPTED on the 11th day of December, 2006. ~ Susan Narvaiz Mayor ) J
