LICENSE AGREEMENT Date: !)e.u.m..b-t.r \'z"J 2006 Licensor: City of San Marcos, 630 E. Hopkins Street, San Marcos, Hays County, Texas 78666 Licensee: Texas State University-San Marcos, 601 University Drive, San Marcos, Texas 78666 Consideration: Ten and no/1 00 Dollars and other good and valuable considerations, including the LIcensees performance of its obligations under thIS agreement. Property: Guadalupe Street improvements within CIty nght-of-way are depicted in the attached Exhibit A and include the following: (a) the west curb will be moved two (2) feet toward the property line from the existing west curb location, from the retail shopping north property line to Wood Street; (b) seven (7) landscaped curbed islands will be constructed from the retail shopping north property line to Wood Street with trees and landscaping planted within the islands; (c) Texas State University-San Marcos' standard sidewalk and ADA accessible ramps, with inlaid pavers, will be constructed from the retail property line to Wood Street; and (d) approximately eight (8) forty-five (45) degree angled parking spaces will be provided along west side of Guadalupe Street. LBJ Drive improvements within the City right-of-way are depicted in the attached Exhibit B and include the following: (a) the existing east curb on LBJ Drive will remain in its current location; (b) four landscaped curbed islands will be constructed from University Drive to the north driveway of Lantana Hall with trees and landscaping planted within the islands; and (c) approximately eleven (11) forty-five (45) degree angled parking spaces will be provided along the east side of LBJ Drive. RECITALS A. The Licensee desires to use the Property for the construction and maintenance of sidewalks and landscaping in conjunction with the adjoining tract of property owned by the Licensee. B. The Licensor is willing to grant the Licensee a license and permission for the construction and mamtenance of sidewalks and landscaping on the Property in accordance with the terms and conditions of this agreement. The sidewalks and landscaping are referred to in this agreement as the Improvements. c. The Licensor agrees that any future changes to the Improvements or changes to sidewalks across the street from the Improvements will comply with the Urban, Architectural, and Landscape Design GUIdelines implemented in Texas State University- San Marcos 2006-2015 Campus Master Plan and Guidelines.
