<br />LICENSE AGREEMENT <br /> <br />Date: !)e.u.m..b-t.r \'z"J <br /> <br />2006 <br /> <br />Licensor: City of San Marcos, 630 E. Hopkins Street, San Marcos, Hays County, <br />Texas 78666 <br /> <br />Licensee: Texas State University-San Marcos, 601 University Drive, San Marcos, <br />Texas 78666 <br /> <br />Consideration: Ten and no/1 00 Dollars and other good and valuable considerations, <br />including the LIcensees performance of its obligations under thIS agreement. <br /> <br />Property: Guadalupe Street improvements within CIty nght-of-way are depicted in <br />the attached Exhibit A and include the following: (a) the west curb will be moved two (2) <br />feet toward the property line from the existing west curb location, from the retail <br />shopping north property line to Wood Street; (b) seven (7) landscaped curbed islands <br />will be constructed from the retail shopping north property line to Wood Street with trees <br />and landscaping planted within the islands; (c) Texas State University-San Marcos' <br />standard sidewalk and ADA accessible ramps, with inlaid pavers, will be constructed <br />from the retail property line to Wood Street; and (d) approximately eight (8) forty-five <br />(45) degree angled parking spaces will be provided along west side of Guadalupe Street. <br /> <br />LBJ Drive improvements within the City right-of-way are depicted in the <br />attached Exhibit B and include the following: (a) the existing east curb on LBJ Drive will <br />remain in its current location; (b) four landscaped curbed islands will be constructed from <br />University Drive to the north driveway of Lantana Hall with trees and landscaping <br />planted within the islands; and (c) approximately eleven (11) forty-five (45) degree <br />angled parking spaces will be provided along the east side of LBJ Drive. <br /> <br />RECITALS <br /> <br />A. The Licensee desires to use the Property for the construction and maintenance <br />of sidewalks and landscaping in conjunction with the adjoining tract of property owned <br />by the Licensee. <br /> <br />B. The Licensor is willing to grant the Licensee a license and permission for the <br />construction and mamtenance of sidewalks and landscaping on the Property in <br />accordance with the terms and conditions of this agreement. The sidewalks and <br />landscaping are referred to in this agreement as the Improvements. <br /> <br />c. The Licensor agrees that any future changes to the Improvements or changes <br />to sidewalks across the street from the Improvements will comply with the Urban, <br />Architectural, and Landscape Design GUIdelines implemented in Texas State University- <br />San Marcos 2006-2015 Campus Master Plan and Guidelines. <br />
