177. <br />Regular Meeting April 14, 2003 Page 9 <br /> <br />Regular Meeting held March 24, 2003 to add: see Minutes of April 14, 2003 <br />regarding the preceding Ordinance on Page 7 following the Ordinance <br />caption regarding the Release of a Utility Easement in the former Pecan <br />Street Right of Way between Sessom Drive and Live Oak Street to Southwest <br />Texas State University and Ms. Narvaiz seconded the motion. Mr. Mayhew <br />stated Mayor Habingreither and Mr. Mihalkanin inadvertently voted on an <br />item pertaining to Southwest Texas State University, in which they should <br />have abstained from the vote. The Council then voted unanimously for the <br />approval of the minutes of the Regular Meeting held March 24, 2003. <br /> <br />Mayor Habingreither introduced for consideration Item 17, removed from the <br />consent agenda, approval of a motion (1) for use of Water/Wastewater <br />~Utility Fund Contingency Funds in the amount of $38,638.00 and (2) for use <br />of Electric Utility Fund Contingency Funds in the amount of $38,638.00 to <br />supplement the purchase of the Utility Billing Customer Information System <br />software, hardware and related professional services from N. Harris <br />Computer Corporation of Canada. Mr. Mayhew moved for the approval of the <br />motion and Ms. Narvaiz seconded the motion. Mr. Mihalkanin inquired <br />whether other municipalities have used this company before. Mr. O'Leary <br />stated this motion provides the funding from the two sources, which then <br />would put the funds in place for purchase of the Utility Billing Customer <br />information system. The Council then voted unanimously for the approval <br />of the motion. <br /> <br />Mayor Habingreither introduced for consideration Item 18 removed from the <br />consent agenda, approval of an Ordinance on second reading, the caption <br />which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CITY CODE SECTION 42.102 TO DESIGNATE AN AREA WITHIN THE <br />CITY AS THE DUNBAR HISTORIC DISTRICT, ALONG THE 200 THROUGH 600 <br />BLOCKS OF MARTIN LUTHER KING, JR. DRIVE, THE 200 THROUGH 500 BLOCKS <br />OF CENTRE STREET, AND THE 200 BLOCKS OF HERNDON STREET, SHADY LANE, <br />SOUTH COMANCHE STREET AND SOUTH FREDERICKSBURG STREET; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Mayhew moved for approval of the Ordinance on second reading and Ms. <br />Narvaiz seconded the motion. Mr. Taylor inquired if this Ordinance <br />passes what will happen if Habitat for Humanity has a lot in this <br />District. He asked if Habitat for Humanity would be able to build an <br />affordable home on their lot. Mr. Mark Taylor stated new construction <br />would be regulated by certain proprieties and compatibility as other <br />historic districts. Mr. Theriot stated new homes have been built on San <br />Antonio and they went through the Historic Preservation Commission. The <br />newly constructed home exterior would need to be similar to the <br />surrounding houses. The Council then voted unanimously for approval of <br />the Ordinance on second reading. <br /> <br /> <br />
