<br />, ORIC:NAL <br /> <br />THE STATE OF TEXAS <br /> <br />~ <br />~ <br />~ <br /> <br />LEASE AGREEMENT <br /> <br />THE COUNTY OF HAYS <br /> <br />THIS LEASE AGREEMENT, made this day by and between Hays County, <br />heremafter referred to as "lessor," and San Marcos Area Food Bank Inc. hereinafter <br />referred to as "lessee," <br /> <br />I. <br /> <br />WITNESSETH: <br /> <br />Lessor, Trustee, is the owner of the following described property, <br /> <br />being Part of Lot eight (8) (NW 45x80) in Block Four (4) of the <br />D.S. Combs Addition to the City of San Marcos in Hays County, Texas <br />LESS AND EXCEPT, HOWEVER the portion of said lot which was <br />conveyed by and described in a substitute Trustee's deed from O. J. <br />TATUM, Substitute Trustee, to MRS. JANE S. BOULDIN, dated <br />November 6, 1935 and recorded in Volume 110, Pages 364-366 of the <br />Deed Records of Hays County, Texas. <br /> <br />II. <br /> <br />Lessor has leased, and does hereby lease, unto said Lessee the above-described <br />real property for a period of twenty (20) years, from January 1, 2007 to December 31, <br />2026, at a yearly rental of $1.00 due and payable in advance, the first of said rental <br />installments for the month of January, being due and payable on or before January 31, <br />2007. Lessee agrees to pay said yearly rental on or before the 1 st day of January of each <br />and every year. <br /> <br />III. <br /> <br />The above described real property is to be used by Lessee during the term of this <br />lease as a "food bank" premise, and Lessee binds himself to so occupy and use the said <br />premises as to violate no federal, state or municipal law, rule or ordinance, and to protect, <br />indemmfy and hold harmless Lessor, his successors and assigns, from any liability of <br />whatsoever nature and character, growing out of, arising from, or connected with, the use <br />of the said premises by Lessee under this agreement. Lessee agrees not to sublet or <br />sublease the buildmg WIthout express written consent of Lessor. <br /> <br />IV. <br /> <br />Upon the termination of this lease, whether such termination occurs by virtue of <br />the expiration of the time limit, or otherwise, Lessee binds himself, his heirs and legal <br />
